Leaked Documents Show History of Problems at Diebold

Andy Stephenson, Voting Activist and Candidate for Washington’s Secretary of State Releases 150 pages of leaked documents received anonymously from Diebold Whistle Blower

SEATTLE – Memos obtained by nationally recognized voting activist, and Democratic Candidate for Washington State’s Secretary of State, Andy Stephenson, were released today. These documents show that Diebold, maker of leading touch screen voting machines, knew of problems early on with their voting systems.

Diebold’s lawyers characterized California as a legal minefield. Now, Diebold could very well find itself embroiled in a false-claims lawsuit, potential grand jury investigations, and investigations by state and local elections authorities and lawsuits by counties.

A key question in the documents is whether California Secretary of State Kevin Shelley has the power to investigate the company's practices, and whether or not he has the authority to de-certify the Diebold equipment. Also at issue is the deployment of uncertified software patches. Information also contained within the memos calls into question the company’s smart card activation system. A system, Ken Clark one of the principal engineers at Diebold…raised some concern about in memos previously released by Bev Harris www.blackboxvoting.org.

5. story of how reporter got memos authenticated
OK, this is third hand so take it with a large grain of salt. I wanted to know how the reporter, Ian Hoffman, got the quote from Diebold attorney Dan McMillan that these were indeed their memos.

Story is, shortly before deadline, he called McMillan at home. Wife gave cell phone. He called that, reached the attorney at a Lakers game. Now, I don't have a lot of sympathy for McMillan. He said some very arrogant and downright libelous things outside the courtroom in the recent TRO. Sort of a yuppie corporate We Own the World How Dare Anyone Question Us type of thing.

Anyway, reporter tells McMillan he has a few questions. McMillan says, "Call me tomorrow, not now"

Reporter says "I really don't think you want to do that." and proceeds to read McMillan one of his memos.

Apparently you could hear the scream above the roar of the crowd: "Jeeezus! They've got our documents! We've gotta go NOW!"

Must have been a bad day at the law firm.

Yesterday, by the way, there was a Diebold stockholder teleconference. Part of the gist of this was: The elections division is dragging the whole company down. What are you going to do about this?

Normally I go with first-hand info, but you'll have to hit Andy's link for that -- documents, download 'em. They show a pattern of lying and skirting the law. My contribution to this thread is more along the lines of gossip, though entertaining.

All the best, I'm off to testify to the California legislature in favor of eliminating touch screens, and to make a brief statement for the True Majority "Computer Ate My Vote" press conference and to see if California decertifies Diebold today at the voter panel hearing.

Andy Stephenson: One of the most kick-ass investigators I know.

Voting belongs to the PEOPLE, in the light of day

Give those registrars who are trying to force voting in the dark, the names of all who they can contact to help in the next election, hand counting if necessary

If they scorn that, they scorn the democratic process- which is about people, not about machines and convenience for them

...given all the money they are spending on legal, PR, and botched elections, you would think they could have outfitted all their clients with printers by now.

Yeh, I know, they have to rewrite the program to do that and then get it certified. Guess that would give the companies that already produce voter verified paper ballots too much of an edge.

Oh, also forgot the red herring about rules and regs for voter verified ballots. Seems they can't follow the same rules they already have for optical scan. And for some reason, they can't certify the printers in California, although, by all appearances, the FEC has, since companies that do produce voter verified paper ballot systems have their NASED number.

Wonder if Shelley is working with ghosts of Bill Jones' time in office?

At what point do the Diebold shareholders stop putting up with the constant drain? At what point do they realize the company is hopelessly behind the curve?

That the war against efficient audit able machines is irrational and risking all the contracts for the sake of what can only be clearly intent to install unsafe machines. That stubborn line, at the risk of losing everything over so little shows a desperate attempt to do something else other than merely sell machine contracts.

The same goes for repairs, violations of certification and other practices that could be cleared up to better effect than mere denial.
This looks clearly like intent to defraud both the buyer and the voter for the goal of having the machines exactly as prone to abuse as they are. That goes for glitches, accessibility, tampering, insider control of code, lack of auditable, verifiable results and statewide monopoly. They would rather have those than sell a better product or any product at all.

21. They are as crooked as any other company that just tries to
scam money without providing a "real quality" product.

According to some Quality classes and reference books, this is the definition of it.

Quality: Fit for use.

It means that the product is suited for the intended use and meets the requirements of that use.

I'd say that electronic voting machines that use problem plagued software that is undocumented, uncertified, and not securely maintained and that provide no auditability with paper ballots is not "fit for use".

If there's any interest, I spent several hours compiling the county by county (and by what type of machine) results for the CA recall election. The source was a CA gov source. I have the url somewhere, and I'll post it when I find it if this is useful.

There's some data missing. One thing that would be good to know is what counties did the candidates come from. That wasn't on the CA site that I was using.

The only thing that I can point out is that there's a chart down around cell G85. Notice the wild swings in the touch screen data as compared to the punch card and opti-screen votes. It's not enough, by itself, to make an accusation of anything. But SDs are MUCH looser for the touch screens.

I should have separated out the Diebold data, but at the time I made the file I didn't think of it, and I haven't changed it since I put it on line.

I'll stand by the accuracy of the numbers, but I was hoping someone else might be able to help with the data analysis. I'm not a statistician.
