...currently taking place at city hall.
I have been studying your constitution for the last few days to see what in the constitution helps the issue of gay marriage.
The only part of the constitution which really stands for the rights of people is under Declaration of Rights.
All these people against the issue of gay marriage is basically crying foul against prop 22. Well prop 22 is just a law, and because of that, it can be overturned at any time.
This however is the CONSTITUTION of the State. All your elected officials, and judges have to abide by this.
We don't know how the judges are going to decide this issue, but the fact is, if they deny the rights of gays and lesbians to marry, then they are in fact going against the states constitution, the very constitution they swore to uphold.
So if the court decision is against gay marriage, and you know a same sex couple that has been married, and who intends to fight this issue through the courts, please give them this.
Of course, there are some great ones to get out of the United States constitution as well, but for now, this will do. :)
Article 1 (DECLARATION OF RIGHTS)
-SECTION 1. All people are by nature free and independent and have inalienable rights. Among these are enjoying and defending life and liberty, acquiring, possessing, and protecting property, and pursuing and obtaining safety, happiness, and privacy.
-SEC. 7. (a) A person may not be deprived of life, liberty, or property without due process of law or denied equal protection of the laws; provided, that nothing contained herein or elsewhere in this Constitution imposes upon the State of California or any public entity, board, or official any obligations or responsibilities which exceed those imposed by the Equal Protection Clause of the 14th Amendment to the United States Constitution...
--(b) A citizen or class of citizens may not be granted privileges or immunities not granted on the same terms to all citizens. Privileges or immunities granted by the Legislature may be altered or revoked.
