South Dakota Lawmaker OKs Abortion Ban

PIERRE, S.D. - The House passed a bill Tuesday that would outlaw most abortions in South Dakota, but opponents said it would do nothing but cost taxpayers money if it becomes law.

The bill, passed 54-15, would outlaw abortion unless a mother's life is in danger. It makes no exceptions for rape victims or women who could suffer permanent serious health problems by having babies.

"When we're considering an innocent life, the health of the mother is not a substantial enough justification to take the innocent life," said Republican Rep. Matt McCaulley, chief sponsor of the bill.

The bill would punish those who perform abortions with up to five years in prison and $5,000 fines.

1. Roe V. Wade
Well they can pass a law, but there is already precedent Roe V. Wade so I'm sure it will be overturned.

2. Yes, indeed they can pass anything they want.....
regarding abortion at state level....its a Federal issue.

this wholesale ban in unconstitional. but i just wanted to post this for people who think that somehow the right-wingers arent trying with all their might to outlaw abortion and reproductive autonomy.

4. I think Daschle is the target.
It's pretty clear that an overwhelming majority (of South Dakotans) are anti-choice. They're just looking to make enough news that Dashcle has to come out one way or the other. He's tried to ride the fence some on the issue (as you would have to if you represented SD), but it hasn't been as big a campaign issue. This is an attempt to move it forward for the November election.

They KNOW it isn't constitutional. They're willing to spend the STATE's money to defend a losing case... just to hurt Dascle's re-election chances.
