Novak assault scene video - in the end he RUNS from the Camera
A Take Back the Media SCOOP - Video of Scene of Novak Assault

Just IN - the Video of the pandemonium directly after the assault on Brad - other voices and characters include Tucker Carlson (watch his hair as he goes for the three Octave slam) Nik Green and myself.

Brad will explain what he said and what happened and why Novak IS a traitor.

Near the end you'll see Nik Green and Penny Little of PeopletoPeopleTV give Chase to Novak at the Kerry Campaign Party the night he won the Primary in New Hampshire.

Watch the scene and the victim's charges Here:

1. As a law student, your case is weak
Edited on Sat Jan-31-04 04:01 AM by sgr2
Without video of the ACTUAL shoving incident, and/or proof of physical harm (scratches, bruises) his case will be thrown out at pre-trial. Especially with the "victim" running around talking about his bias towards the "defendent". That being said, it was fun to watch.

3. As a potential juror. . .
I've gotta go with sgr2 that the case is undoubtedly weak. There's a lot to be said for Carlson's rebuttal, too. Kinda hard to make a case of assault by a 70-year-old man. But it was fun to see, no doubt about it. And I take heart that No-facts seems to be slowly losing it. If nothing else, the Plame Blame Game will spell the end for No-facts career.

4. Huh?
The case is weak? Hmmm.....last I heard witness testimony sans video proof is powerful enough to support conviction. As for Carlson's rebuttal....I wonder if you two would react similarily if a 70 year old succeeded in smashing out your teeth or shooting you. Age is not a defense against assault.

My old man died at 68 of a massve cardiac arrest....and I'll tell you right now up until that day he was fully capable of gracefully pounding the living hell out of most 30 year olds.

9. Better read the statute before coming to that conclusion
I suspect that you'll find that there was intentional and unwarranted physical contact and plenty of witnesses, which sounds like a pretty good case to me. Whether it will be pursued or not is another matter-

14. It doesn't matter
He will still have to put up a defense and that takes money and the publicity will be worth everything. It will have to come out that people consider him a traitor. I think CNN should be included in any filing so the publicity will make an impact. Try thinking on a larger scale.

This is key - while hilarious, I don't think there's much of a case either.

But that's not the point! Annoy! Bad press! Put him on the defensive! Remind people about the "traitor" stuff...

win/win allround.

22. Remember 95% of the stuff they threw at Clinton had no merit
But it stuck with the people. Pretty soon even if they didn't believe it all they were tired of hearing about it. Throw as much at them as we can and some is bound to stick. Novak is a Traitor that is a fact whether he is guilty of assault or not I don't have a clue but he may have intimidated the person enough to create psychological damage and in a civil suit that person may gain some sympathy with a jury.

5. Where's HST?
Haven't been over to SI in a while, I'll go.

I mean, reminds me of Fear and Loathing on the Campaign Trail, '72, or just Fear and Loathing proper: When the going get's weird, the weird turn pro, right? Right on!

Go get 'em. Wish Franken was there to tackle him or Carlson or somebody. Justified tackles only, mind you. But I expect Al will have opportunities a plenty till November. Maybe we should pitch in and get him a helmet or some shoulder pads or something.

6. I suspect he's fried
I love the man but the last few times I've seen him in print he seemed a bit....tired.

I hope he's got some fire left in him, we could use it in the coming months. It's gonna get hairy, believe it. Take it to the bank and cash it.

7. For some reason the picture would not come in.
Novak is so old(my age) I would think he could get away with it from what I read. He is sort of a soft man looking for money from what you hear all the time. He was always looked at as a light weight as far as I can recall until he got his face on TV 10 times a day.Now he seems more interested in his tan so he will look good.

25. Right-click the link and choose "Save as..."
Save it to your desktop to make it easier to find. Then, open it - QT should play it fine in its own player...

21. keep waiting
even if it says it's done - it's not..

it may take a while, this is a 16Meg file and it will load.. if it's a .mov then it IS Quicktime and nothing else.

so you should be able to play it..

just like flash used to be, where you could make a pot of coffee sometimes waiting for it to come it, I apologise but that's the web!

and thanks for all the comments!

It's assault - witnesses will testify, and just because it isn't on video doesn't mean it didn't happen, they DID have trials before video was invented :)

and you never know what Novak might say under oath - it could get interesting..

23. Got it. Thanks, But that pot
of coffee has given me the jitters.

This is good stuff. If nothing else it will keep the issue alive.

The victim of Novak's assault is very articulate and informed. He would be great to keep in front of the cameras. Just a thought.

10. Pretty funny stuff...
the 'victim' looked a little like Moses, sans a full pate' of hair.

All things considered, I'd go for the suit anyway, at the minimum, it would go in as 3rd degree assault, a misdemeanor and could help rein in Novak.

There are a lot of other things that might come out in a trial. Let's say Novak was a bit 'tipsy', that would look good for CNN. There may well be other videos out there as well, and there is always the eyewitness accounts that could be brought into the record.

In the long run...if the gentleman that was 'assaulted' wishes to press charges, he should; at the least, it would bring unwanted publicity to CNN, and cost Novak some good money to defend himself.
I would like to see him on the stand explaining why he found it necessary to shove an elderly man out of the way, just because he was calling him a 'traitor'. Repugs call me a traitor all the time; I'd look like a gorilla if I popped 'em all. I laugh it off, there is more patriotism in my little toe than most of these people have combined.

As an addendum: I might have wound up in jail if Novak shoved/punched/or otherwise assaulted me; but Novak would have spent a few weeks in the hospital in traction. i am not an advocate of violence, but I believe in self defense.

19. Did you file charges?
The notion that the case is weak because of the age of the assailant or because there is no video evidence is bogus.

24. PLEASE let Tucker Carlson be called as a witness to the assault
He admitted twice that Novak pushed the victim.

BTW, assault (at least in some states) does not even require physical contact - that's battery. Assault simply means causing a reasonable person to feel fear. Actual contact is just icing on the cake.

GO AHEAD AND STAND UP TO THESE BULLIES ! By all means press charges.

28. My wife
made that same observation - that Carlson IS A WITNESS..

and Begala is ALSO a witness.. I saw him come out on the heels of Novak - He's one of the people that pushed Novakula into the CNN Bus to try and defuse the situation..

interesting, it would be nice to ask Novak and the rest a few questions..

27. Perhaps Bob could try the 'fighting words' defense, a more manly posture
than 'it was an accident'.

Would he then not have to challenge the veracity of the insult?

It would be fun to prove in court that he is a traitor!
