Libya's liberation: interim ruler unveils more radical than expected plans for Islamic law

Mustafa Abdul-Jalil, the chairman of the National Transitional Council and de fact president, had already declared that Libyan laws in future would have Sharia, the Islamic code, as its "basic source".

But that formulation can be interpreted in many ways - it was also the basis of Egypt's largely secular constitution under President Hosni Mubarak, and remains so after his fall.

Mr Abdul-Jalil went further, specifically lifting immediately, by decree, one law from Col. Gaddafi's era that he said was in conflict with Sharia - that banning polygamy.

Libya is already the most conservative state in north Africa, banning the sale of alcohol. Mr Abdul-Jalil's decision - made in advance of the introduction of any democratic process - will please the Islamists who have played a strong role in opposition to Col Gaddafi's rule and in the uprising but worry the many young liberal Libyans who, while usually observant Muslims, take their political cues from the West.

I've had several Republican acquaintances tell me that the President is at war with the allies of the west...that he is helping to overthrow "reasonable middle easterners" with Islamists.

"al quaeda" used very loosely. They likey have nothing to do with the OBL network, except using the moniker. The story never got traction> I think that is because it is nothing more than speculation.

trying to link the installation of Sharia law into a new libyan leadership directly to AQ is a s-t-r-e-t-c-h.

Who is Abdul Hakim Belhadj, the leader of the Libyan rebels?

His name has been in the news a lot recently, but who exactly is Abdul Hakim Belhadj, the military commander of the Libyan rebels?

In March 2010, Al Jazeera broadcast a film of a meeting between Belhadj after his release from prison in Libya under the initiative of the Gaddafi Charity Foundation following the intervention of Saif al-Islam Gaddafi. More than 700 of the "leaders" of the Libyan Fighting Group have been released in stages, even though they were accused of joining Al-Qaeda; some were also accused of fighting in Afghanistan, Iraq and Pakistan. In the film, Abdul Hakim Belhadj praises the mediation of Dr Saif al-Islam for his release.

In an interview at the time, Saif al-Islam told reporters that the men who had been released "were no longer a danger to society" so he has no problem about their release. A year or so later, Belhadj was entering Tripoli at the head of a rebel army searching for Saif al-Islam Gaddafi and his father. So who is Abdul Hakim Belhadj?

Born in 1966 in the Libyan capital Tripoli, Abdul Hakim Khuaelide, or Abdul Hakim Belhadj as he became known, is a son of the Islamic movement in the country. He graduated from the school of engineering and was one of the most prominent young men involved in the Afghan jihad against the Soviet Union in the late nineteen-eighties. Belhadj was a "Mujahid", travelling with his Shaikh, Abdullah Azzam, and other luminaries of jihad in places like Pakistan, Afghanistan, Turkey and Sudan.

21. Frankly, the connection or lack of it to Al-Queda is a red herring
One can be a rigid, bloodthirsty and repressive Islamist and have no connection with the loose confederation that is Al-Queda. It's rather amorphous anyway.

It's like an American Nazi saying he has nothing to do with those Klan guys.

It will be an interesting next few months, and if history is any guide, things will get at least a bit unstable after a few months. All of this will, of course, play into the hands of the Republicans, as will the Iraq withdrawal.

No offense meant to you; you've been on the moral and ethical side of the Libya debates...

In an interview with the Italian newspaper Il Sole 24 Ore, Mr al-Hasidi admitted that he had recruited "around 25" men from the Derna area in eastern Libya to fight against coalition troops in Iraq. Some of them, he said, are "today are on the front lines in Adjabiya".

It has been said, “In war, truth is the first casualty.” Libya is no exception. From the lies that started the war, to the rebels linked to al-Qaeda, ethnically cleansing black Libyans, killing civilians, propaganda, PR firms, intelligence agents, and possible occupation; Libya is a more complex story than the fairy tale we have been sold. Reality always is.

What Were the ‘Reasons’ for ‘Intervention’?

We were sold the case for war in Libya as a “humanitarian intervention.” We were told, of course, that we “needed” to intervene in Libya because Muammar Gaddafi was killing his own people in large numbers; those people, on the same token, were presented as peaceful protesters resisting the 40-plus year reign of a brutal dictator.

In early March of 2011, news headlines in Western nations reported that Gaddafi would kill half a million people.<1> On March 18, as the UN agreed to launch air strikes on Libya, it was reported that Gaddafi had begun an assault against the rebel-held town of Benghazi. The Daily Mail reported that Gaddafi had threatened to send in his African mercenaries to crush the rebellion.<2> Reports of Libyan government tanks sitting outside Benghazi poised for an invasion were propagated in the Western media.<3> In the lead-up to the United Nations imposing a no-fly zone, reports spread rapidly through the media of Libyan government jets bombing the rebels.<4> Even in February, the New York Times – the sacred temple for the ‘stenographers of power’ we call “journalists” – reported that Gaddafi was amassing “thousands of mercenaries” to defend Tripoli and crush the rebels.<5> Italy’s Foreign Minister declared that over 1,000 people were killed in the fighting in February, citing the number as “credible.”<6> Even a top official with Human Rights Watch declared the rebels to be “peaceful protesters” who “are nice, sincere people who want a better future for Libya.”<7> The UN High Commissioner for Human Rights declared that “thousands” of people were likely killed by Gaddafi, “and called for international intervention to protect civilians.”<8> In April, reports spread near and far at lightning speed of Gaddafi’s forces using rape as a weapon of war, with the first sentence in a Daily Mail article declaring, “Children as young as eight are being raped in front of their families by Gaddafi’s forces in Libya,” with Gaddafi handing out Viagra to his troops in a planned and organized effort to promote rape.<9>

As it turned out, these claims – as posterity notes – turned out to be largely false and contrived. Doctors Without Borders and Amnesty International both investigated the claims of rape, and “have found no first-hand evidence in Libya that rapes are systematic and being used as part of war strategy,” and their investigations in Eastern Libya “have not turned up significant hard evidence supporting allegations of rapes by Qaddafi’s forces.” Yet, just as these reports came out, Hillary Clinton declared that the U.S. is “deeply concerned by reports of wide-scale rape” in Libya.<10> Even U.S. military and intelligence officials had to admit that, “there is no evidence that Libyan military forces are being given Viagra and engaging in systematic rape against women in rebel areas”; at the same time Susan Rice, U.S. Ambassador to the United Nations, “told a closed-door meeting of officials at the UN that the Libyan military is using rape as a weapon in the war with the rebels and some had been issued the anti-impotency drug. She reportedly offered no evidence to backup the claim.”<11>

An emir of the LIFG, Abdelhakim Belhadj,<24> became the commander of the Tripoli Military Council after the rebels took over Tripoli during the 2011 Battle of Tripoli.

NOTE - This group represents < 3% of all Libyans. But it is so easy to use that goddamned paintbrush again, and paint everyone the same.

The legal systems in 21st century Muslim majority states can be classified as follows:

Sharia in the secular Muslim states: Muslim countries such as Mali, Kazakhstan and Turkey have declared themselves to be secular. Here, religious interference in state affairs, law and politics is prohibited.<37> In these Muslim countries, as well as the secular West, the role of sharia is limited to personal and family matters.

The Nigerian legal system is based on English Common Law and the constitution guarantees freedom of religion and separation of church and State. However eleven northern states have adopted sharia law for those who practice the Muslim religion.<38>

Muslim states with blended sources of law: Muslim countries including Pakistan, Indonesia, Afghanistan, Egypt, Sudan, Morocco and Malaysia have legal systems strongly influenced by sharia, but also cede ultimate authority to their constitutions and the rule of law. Is our Middle East policy supposed to support dictators as long as they help us fight al-Queda. If so how does that differ from a republican foreign policy? Or are you saying that the UN wanted al-Queda to take over Libya for some reason?

Why don't we wait to see who gets elected in Tunisia, Egypt and Libya before we jump to the conclusion that conservatives are right - "the choice is between dictatorship and a fundamentalist Islamic state. Libyans (or Tunisians or Egyptians) are not capable of anything approaching a democratic government."

The Muslim Brotherhood was an obvious ally against Nasser, because he had abolished it from Egypt after it was involved in a failed assassination attempt on his life in 1954. The Brotherhood rejected Nasser's policy that, for the most part, kept religion out of politics. Officially the Brotherhood was an outlawed organization, but it remained influential and active within Egypt working against the secular regime, often hand-in-hand with British Intelligence. In June of 1955 MI6 was already approaching the Brotherhood in Syria to agitate against the new government that showed strong left-wing tendencies and a desire to merge with Egypt (2). The Brotherhood became an even more important asset after Nasser announced the Egyptian takeover of the Suez...
