Samuel Alito’s America

ALITO WOULD OVERTURN ROE V. WADE: In his dissenting opinion in Planned Parenthood v. Casey, Alito concurred with the majority in supporting the restrictive abortion-related measures passed by the Pennsylvania legislature in the late 1980’s. Alito went further, however, saying the majority was wrong to strike down a requirement that women notify their spouses before having an abortion. The Supreme Court later rejected Alito’s view, voting to reaffirm Roe v. Wade.

ALITO WOULD ALLOW RACE-BASED DISCRIMINATION: Alito dissented from a decision in favor of a Marriott Hotel manager who said she had been discriminated against on the basis of race. The majority explained that Alito would have protected racist employers by “immuniz an employer from the reach of Title VII if the employer’s belief that it had selected the ‘best’ candidate was the result of conscious racial bias.”

ALITO WOULD ALLOW DISABILITY-BASED DISCRIMINATION: In Nathanson v. Medical College of Pennsylvania, the majority said the standard for proving disability-based discrimination articulated in Alito’s dissent was so restrictive that “few if any…cases would survive summary judgment.”

ALITO WOULD STRIKE DOWN THE FAMILY AND MEDICAL LEAVE ACT: The Family and Medical Leave Act (FMLA) “guarantees most workers up to 12 weeks of unpaid leave to care for a loved one.” The 2003 Supreme Court ruling upholding FMLA essentially reversed a 2000 decision by Alito which found that Congress exceeded its power in passing the law.

ALITO SUPPORTS UNAUTHORIZED STRIP SEARCHES: In Doe v. Groody, Alito agued that police officers had not violated constitutional rights when they strip searched a mother and her ten-year-old daughter while carrying out a search warrant that authorized only the search of a man and his home.

ALITO HOSTILE TOWARD IMMIGRANTS: In two cases involving the deportation of immigrants, the majority twice noted Alito’s disregard of settled law. In Dia v. Ashcroft, the majority opinion states that Alito’s dissent “guts the statutory standard” and “ignores our precedent.” In Ki Se Lee v. Ashcroft, the majority stated Alito’s opinion contradicted “well-recognized rules of statutory construction.”

2. WHERE is there a biography on this neanderthal?
Edited on Mon Oct-31-05 08:02 AM by Divernan
I have googled him and come up with nothing except a few referrals to some judicial opinions, and a number of articles about ANOTHER Samuel Alioto - who is president and CEO of a pharmaceutical/beauty product company called MediNiche, which collaborates with another pharmaceutical company called CollaGenex Pharmaceuticals. Is this Pharma Alioto related to the Judge? I haven't seen reference to the judicial nominee's age, marital status, education, children, etc. What's his family background? There have been descriptions of him as Catholic. Given his ultra conservative rulings, I suspect he's another rapid Opus Dei fanatic, like Scalia and Clarence. Given Opus Dei's aggressive recruiting, they'd have gone after him when he was first appointed a judge by Bush, Sr., if Alioto wasn't already a member. I'd like to know what parish he belongs to. Is it his neighborhood church, or some Opus Dei enclave?

As to his rulings, I was particularly surprised he opposes the Family Medical Leave Act. In our society, where nearly every working person has either still-at-home-children, aging parents, or a spouse/partner in need of help re medical conditions/emergencies, the FMLA is used by one hell of a lot of people. And they are EXTREMELY grateful for it's protections. Alioto might as well attack motherhood.

3. Motherhood?
Yep, he's already done that or at least one's right to choose motherhood.

He's going down.

4. Yes, but what church does he attend? Does he read the Bible daily?
What are his favorite Old Testament readings ? That's what is important to us 'murcans.

6. Puhleeze! Familiarize yourself with Opus Dei.
This extreme right, ultra conservative, semi-secret branch of the Catholic Church has a very strong conservative political agenda. You can see it in Scalia/Thomas dissents when it comes to upholding the separation of church and state. I say this as a product of 19 years of Catholic education (including Jesuit university & lCatholic aw school) and someone who left the Catholic church as soon as I left my childhood home.

10. Opus Dei numeraries are only allowed to read the specific items
provided to them by their mentor. Nothing else.

It's usually internal Opus Dei articles and tracts, I'm told by my niece (who is one).

5. I can't wait to watch how the Democrats deal with this one.
It's pretty clear it's flilibuster or cave. And if they cave there will be hell to pay within this party.

8. Excuse me, but, its "Sam" not "Samuel"
You have to get informal...like Bush**. Ya gotta relax. Sam's the man. Sam Alito did this. Sam Alito did that. Sam Alito was a beer guzzling frat boy just like me (Obligatory slap on the back). Bush** will be using a nickname for him shortly. "Scalito" or "Scarface" or something.

I was thinking about it this weekend. I know what's wrong with this administration. Its not that they are greedy, lying, idealogues. (Ok..that's part of it). No, the real problem with this administration is their nicknames! Brownie, Scooter, W, and Fart Blossom. C'mon! These are nicknames for losers! They need some 'real man' nikcnames like "Rock", "Tank" and "Bruiser". Only then, can they lead this nation to the glorious food trough of manna envisioned by the enlightened PANC brethren. Thank you, and God Bless
