Bill O'Reilly and the Fox News Channel producer accusing him of sexual harassment hit the airwaves yesterday in an increasingly ugly war of words as the anchor acknowledged that his career is on the line.

"I knew I was going to get vilified and vile stuff was going to be put out there," O'Reilly said in a telephone interview. "It's very embarrassing to have this stuff out there. Any human being would be depressed to see this. . . . This is the worst day of my life. . . . I have to protect the people closest to me. If I have to suffer, that's the way it has to be."

"I knew I was going to get vilified and vile stuff was going to be put out there," O'Reilly said in a telephone interview. "It's very embarrassing to have this stuff out there. Any human being would be depressed to see this. . . . This is the worst day of my life. . . . I have to protect the people closest to me. If I have to suffer, that's the way it has to be."

O'Reilly said he could not, on his lawyer's advice, address producer Andrea Mackris's accusations that he subjected her to graphic phone-sex chats -- a tactic that her attorney, Benedict Morelli, seized upon.

"Guys like O'Reilly who like to espouse what right-wing Republicans espouse about family values shouldn't be doing stuff like this," he said, adding: "The man knows he did it. He finally got it through his thick skull that he did it, and he's not going to get away with it. . . . He's going down."

33. Too bad you missed C-SPAN2's "Book Club" confrontation last spring
between Al Franken and O'Lielly. O'Lielly snarled about the picture of him on the cover of Al's book and Al walked over to him, put the book in his face, and offered to (1) replace it with a better picture of him if O'Lielly could provide one to him, or (2) air-brush the blotches out of the picture on the cover. :)

O'Lielly apparently didn't have any photos that didn't show the blotches, because all he could tell Al was to "shut up!"

Then Al went back to attacking O'Lielly about O'Lielly's phony claims about the Peabody awards, etc.

It was hilarious - Al really got under O'Lielly's skin - O'Lielly threw several classic shitfits during the broadcast.

Swear to God--he thinks he's Kobe Bryant! There's a big difference between a hotel worker with a HS education and an executive producer making almost a hundred K with a college degree. She was ready for him--and good for her. No one should have to put up with that crap, especially when you tell them more than once to cut it out. She should not have to choose between a paycheck and ANY kind of abuse.

I can't wait for the release of the tapes--I want to hear him speak the famous "middle eastern delicacy and shower scrub" line! The hilarity, the absolutely totally decadent, voyeuristic and prurient interest in not the sex part, but the listening to him making a total ass of himself part! Such delight!

That is probably why she went for such a high paycheck--it's worth it to him to never have those tapes played, EVER. The coarse language, the suspicious buzzing in the background, his descriptions of what he was doing (you KNOW she held the really GOOD stuff back). I'm sure his pregnant wife is less than delighted with the transcripts, as they are--the tapes will ensure she takes whatever he has left in the divorce.

Gee, couldn't happen to a nicer guy!

Naturally, there's a complicating factor thrown into the equation, and it's spelled B-A-B-E. O'Malley and Michaels are in love with the same woman, Ashley Van Buren, a 31-year-old tabloid reporter with a "large bust that both helped and hurt her" career. The Vassar grad, employed by a newspaper that has all the markings of the New York Post, is tenacious in her quest for the truth. Assigned to cover the murders, she gets personally involved with both of the O'Reilly personas. At first, she cannot resist the charms of the evil O'Reilly — and the narrator tells us why, in the form of a dating tip. "Shannon had learned a long time ago that being coy was an essential part of flirting. Women liked confident men, but they also liked little boys. For men, the trick was to combine the two qualities."

Sticking with convention, though, the good O'Reilly — that is, not the psychopathic murderer — gets the girl in the end. "Her painful, dangerous ordeal had turned into one of the most joyous times of her life," we learn on the last page. The scene takes place on a Caribbean beach, where the narrator waxes on. "Out of confusion and chaos, Ashley Van Buren had found clarity and happiness. And, as she wrapped her slender arms around Tommy's thick neck, she hoped those new feelings would deepen and last forever." For his part, O'Malley "was naked and at attention."

Yes, no thriller would be complete without sex, and the inimitable quality of O'Reilly's erotic prose in Those Who Trespass has been extensively documented on Salon and elsewhere. Still, it's worth noting a few things about O'Reilly's writing. Kirkus Reviews calls the language "wooden"; one could stick to the simpler adjective "bad." Within the first 10 pages, for example, we're treated to "the clouds were assembling in the west," "is intense sexual hunger was apparent to anyone who bothered to notice," and "he did what he usually did when gratification eluded him — he got unpleasant."

I lived on a Greek cruise ship for a year and I always looked forward to Egypt(Wednesday) and Haifa in Israel (Thursday) because I could get falafel sandwiches. I've never seen falafel sold in Greece.
And it is the Palestinians who owned the falafel shops in Haifa. It is one city where Arabs and Israelis have managed to co-exist fairly well.

I still haven't checked out what the hell O'Reilly is talking about when he mentions the falafel. Afraid to.

Brian Lamm was good too, he even asked some of these idiots what about Clinton. How'd you feel about that? Well, Clinton was a bad man who got caught but never punished. Brian asked what about the impeachment? The guy said, well yea, but nothing happened to him!

I love cspan, but I've got to learn to mute the damn TV for every other call!!!

Me too. The wingnuts they allow on are too far gone. Unfortunately, the "Supporters of Senator Kerry" they choose to broadcast are often inarticulate and uninformed as well. One morning I called in, was screened, put on hold, and promptly disconnected. Washington Journal routinely quotes from the Moonie Times and has a parade of administration shills to parrot the party line. Balanced it isn't.

53. I don't think they're biased.
I really do wath it evrey day, and although I don't keep count, I see one guest from each side all the time. I don't know about how they handle the phones, but I have noticed that some of the hosts screw up the phone buttons all the time! The worst with the buttons is Brian. I think he does the best interviewing job of any of them, but he's sure bad with the phone buttons!

One minute, in his sick little mind, he's getting kinky with his producer, the next minute he has a craving for good middle eastern food!!! Either that, or he's never had the pleasure of good middle eastern food, and in his experience, falafel tastes just like a loofah!

He wanted the plantiffs to release the tape (so he says) but what that really was about was he wanted to see their hand. Also, if they released a tape, he could work to get it thrown out. They have him on tape, make no mistake, with all the battery-buzzing background noise. Oh, how SALACIOUS! It makes for a good laugh, and it could not happen to a "nicer" guy!!!!

I'll tell ya, Roger Ailes has got to be bullshit--DildO'Reilly basically told that woman that Faux rules the world. in this case, extortion, where no criminal charges have been made against the woman by law enforcement? Didn't he file his suit first?
That didn't make a lot of sense to me, but I thought that was what I read.

Bill Cosby was involved in a case a few years ago, when a woman asking him for money, claiming that she was his daughter, was tried in federal court for a blackmail scheme. That was in federal court, I assume because 2 different states were involved, and a tape recording was allowed as evidence. She was found guilty.

conduct. E.g., "battery". It's both a crime and a cause of action for civil money damages and injunctive relief (court orders).

Sex discrimination, however, is a purely civil matter.

A victim of a crime does not have to press criminal charges in order to bring a civil suit. Although in most such cases, a civil suit will be more likely to succeed once a criminal conviction is obtained.

In Fox's case, I haven't seen the Complaint so I don't know all of the trumped up allegations against this woman, but I have heard it involves requesting the court for an order allowing them to fire her in retaliation for her public complaints against O'Reilly without it being deemed retaliatory, which is absurd on its face and which will, I'm sure, be summarily thrown out of court. Beyond that, who knows what's in the fetid imagination of Fox's incompetent lawyers? If the woman hasn't filed suit against O'Reilly yet, I'm sure it's just a matter of time before it happens, after reading what her attorney has to say.

He HAD banged her mother though, and they tried to shake him down, counting on him not wanting to ruin his good guy image. But he KNEW she wasn't his kid, so he preemptively sued her. He had to confess to the wife, but even if he gave her the money he would have given the girl, it would at least stay in the family.

ok, this is embarassing, but I'm wondering about the legalities of recording phone conversations, there's got to be something that can help her case technically. about 20 or so years ago when I was a pre-adolescent growing up in Salt Lake City (my excuse for the following_ my friend and I got caught making prank phone calls. this one number we had called repeatedly traced our calls apparentely b/c one morning a cop showed up at my family's doorstep and told my mom all about it, another cop visited my friend. then when we met with the juvenile deliquent people (seemed a bit harsh, I have no record of anything, ever) they read excerpts from what we said, I will never forget that moment and how embarassed and ashamed I was, I didn't even know what some of the words I said meant, and told my mom that, as if that helped. so I guess that was the punishment, an extremely awkward family (though my mom decided not to tell my dad b/c he would not take it as well as she did, my mom is very cool). so long story short, how did they legally have transcripts if it's illegal to tape? or maybe they just traced the numbers and the convos were written down simply to embarass us in front of our family? that would make sense, especially in Utah.

I can hardly wait for the nextnew Daily Show!!

plus there are also federal statutes. Here's a link to a site with some info:

It says that in NYS, only one party consent is needed, but that judges do not always allow the recordings into court.

Yet remember Linda Tripp taped Monica Lewinsky in Howard County, MD where one-sided taping was illegal and in fact, the Radio Shack guy told her so when she bought the gizmo to tape her phone calls with Monica. But she was NEVER charged with or penalized for breaking the law AND the content of many of the tapes became common knowledge. That's how "the elves" and that Newsweak SOB Michael Isikoff got wind of the infamous blue dress!

So much for GOP respect of the law. I hate these bastards!

that it's merely a matter of evidence law. It's not illegal per se to tape someone's phone conversation. But if not obtained with consent of the person against whom the tape is introduced as evidence, the tape is inadmissible as evidence. In California, there taping devices have to emit a beep about every 20 seconds to notify the person on the other end of the line that they're being taped. In addition, the person taping has to orally tell the person the conversation is being taped. All of this must be on a seemless recording in order for the taped record to be admitted into evidence.

IOW, it's strictly a matter of evidence law and admissibility in court proceedings.

As there was no court proceeding in the Lewinsky/Impeachment matter, Tripp's recordings of Lewinsky's phone conversations were never offered into evidence in a court proceeding, so there was never a ruling. They merely became a part of the special prosecutor's report in the impeachment investigation. Ken Starr used them cynically in the impeachment proceedings because he knew he could get away with damaging Clinton that way. But Ken Starr never subsequently filed a claim against Clinton for perjury, as vacuously threatened, because, in part, he knew he couldn't get those tapes admitted in court as evidence against Clinton.

107. We watched Norville last night.
There were two cable/news industry guys and James Wolcott, the Vanity Fair editor who's started his own weblog (and ain't too kind to the media in it, especially cable 'news shows'). The consensus of Wolcott, the two industry guys and Norville was that this woman was in the right to tape the 'Loofah Dialogues' and that O'Really had no leg to stand on if she had tapes because she was well within her rights to do so. They didn't discuss whether or not the tapes were admissible as evidence in a sexual harassment suit, but the general consensus was that if she had taped the conversations she detailed, she very likely had a good case.

84. Tom Leykis' $50,000 offer...
today, on his show Tom Leykis offered to donate $50,000 out of his personal account to the charity of O'Reilly's choice if "Dilldo" would simply look in to the camera and say "these allegations against me are categorically not true".. and then spent the better part of 2 hours saying that he's read and heard almost everything about this breaking case, and that is the one thing O'Reilly simply has not said... leading him to believe whole-heartedly that there are, in fact, tapes... and if they get out, Leykis will get them.

He didn't believe them and thought it was a big mistake to attack Kerry's military record. The wingers were freaking over this. I heard some on the radio and they were raging never to listen to him again.
