Swift boat veteran suspended
Edited on Fri Sep-24-04 09:20 PM by kskiska
PORTLAND, Ore. (AP) — A Clackamas County prosecutor has been suspended for two weeks without pay because he used office equipment to prepare his affidavit as one of the Swift Boat Veterans for Truth, District Attorney John Foote said Friday.

Alfred French, a senior deputy district attorney, used the computer in his office to receive and print a draft of the affidavit on July 21. On the same day, he asked a legal secretary in the office to notarize the document, Foote said in a statement.

The Swift Boat veterans accused Democratic presidential candidate John Kerry of exaggerating his Vietnam war record to win medals. The charges have not been substantiated.

In a Swift Boat ad, French said "I served with John Kerry. ... He is lying about his record." In the sworn affidavit, he said Kerry "wildly exaggerated and lied about his record in Vietnam."

French subsequently acknowledged he relied on the accounts of his friends and did not witness Kerry in combat. That admission led to pickets outside his office and complaints of unethical conduct to the state bar.

1. Hmm... suspended for...
... inappropriate use of office equipment--instead of lying on a sworn, notarized affidavit.

That should restore our faith in the system.

20. From an earlier post today...
I canceled my subscription to the LA times this morning.

I left a polite msg on voice mail of reporter who wrote the story that Times attorney filed suit to unseal Heinz will.
I said that when the sworn affidavits of the lying SBV's are investigated, I'll take the paper again.
There isn't much I can do, but I did what I could.

25. Sometimes you settle for what you can make stick to the bozo...
...even if it's the lesser of the offenses.

People are very careless of how they use their office computers, and what he did (sending and receiving material for personal use, faxing, xeroxing, etc) is so common that a lot of places ignore it unless there's another reason to crack down and then that offense gets used, too.

This D.A. guy should have known better on so many levels -- he was already in hot water for getting caught in a lie about his affair when it was under investigation, then being in the Smear Boat ads brought unwanted noteriety to his office. Very arrogant.

Glad they went easy on the secretary; she probably assumed his request for her notary services was legit, and as a D.A. he certainly outranks her.

3. Cheated on his wife
French had been on paid leave, using vacation time, since last month, when he acknowledged an extramarital affair with a secretary more than a decade ago, and lying about it to a former supervisor.

The woman in question still works at the district attorney's office but does not report to French. Foote said he considers that matter closed.

4. Help counter it.
Now that the GOP is using a loophole to get more Bu$h ads out, Kerry and the DNC are going to do the same but we need to donate now. Sept 30 deadline is near.

It's up to the Oregon Attorney General
to prosecute a county prosecutor for perjury (lying on an affidavit made under oath) if the facts are there.

12. I think it's time that we DU the DA of that county
and remind him that on the county's own page they say --

"The Clackamas County District Attorney's Office is required by state law to represent the state in felony prosecutions, misdemeanor prosecutions, grand jury proceedings, mental commitment hearings, child support actions, family abuse prevention hearings, juvenile delinquency and dependency hearings.

The primary purpose of the Clackamas County District Attorney's Office is to fairly, impartially and honestly enforce all criminal laws. The ultimate goal is to make Clackamas County a safer and healthier place to live."

When you have a PROSECUTOR that has lied not once, but twice, while in that office, once about an affair with someone in that very office to his boss and then again on a SWORN AFFIDAVIT, he can be nothing more than a prosecutorial (is that even a word? LOL) accident waiting to happen. How can he show his face to prosecute anyone when he has shown such disregard to the letter of the law himself? Would he appreciate having a witness that testified based on hearsay? That witness would be exposed and charged with perjury, wouldn't he?

Should this guy be held to any less standard, or is that standard operating procedure for all prosecutions handled by that office?

We should send emails to the DA and CC them to the local newspaper. How are we to maintain belief in a justice system that is obviously tainted by someone that has so little regard for the very office he holds, and the responsibilities that go along with such power?

We can contact that paper at this address (150 words or less if you want them to consider publishing it)-- letters@news.oregonian.com and the DA at this address -- districtattorney@co.clackamas.or.us

Enough is enough. Either they believe that all are subject to the laws or they will allow him to continue to prove that there is two Americas. One for the criminals that they prosecute and one for the insiders.

Suspended for using office equipment improperly? What bullshit. The DA obviously doesn't want to real with the real issue -- an officer of the court lying on an affidavit -- so he came up with this BS.
