Court rejects U.S. Rep. Robert Wexler’s lawsuit over touch-screen voting machines

A panel of state appellate court judges dismissed U.S. Rep. Robert Wexler's lawsuit over touch-screen voting machines Friday, saying that while the right to vote is fundamental state officials don't need to guarantee a perfect voting system.

Wexler, D-Boca Raton, sued in both federal and state court to compel the state government to install paper receipts for Florida's ATM-style touch-screen machines. Fifteen counties -- including Broward, Palm Beach and Miami-Dade -- currently use the electronic voting systems.

Wexler still has an active appeal in the federal court system.

His state-court case ended up in the Fourth District Court of Appeals because Palm Beach County Circuit Judge Karen Miller dismissed Wexler's complaint in state court in February, saying the congressman had no legal right to make a case since he has no opponent in the fall elections.

2. they don't need to guarantee a perfect voting system? who said anything
about perfect? how about something that can be AUDITED? they already lost touch-screen records in Florida. what else do they need to have happen? wholesale loss of data that completely disenfranchises entire COUNTIES?

3. The judge's reasoning sounds weak, doesn't it?
Rep. Wexler has been pushing on getting printed receipts on e-voting machines for a long time. Part of his area is Palm Beach, and he undoubtedly is keenly honked off about the stolen election in 2000.

Palm Beach County is leading efforts to persuade the state to require that electronic voting machines print a voter-verifiable receipt.

Palm Beach County officials on Tuesday bowed to calls for paper voting records by agreeing to install printers on the county's voting machines -- if the state approves their use.

Palm Beach County's decision Tuesday came on the heels of a lawsuit filed by U.S. Rep Robert Wexler, D-Boca Raton, who represents a chunk of Palm Beach County and parts of Broward, including Margate and Coral Springs.

Wexler sued Florida Secretary of State Glenda Hood and Palm Beach County Supervisor of Elections Theresa LePore, saying that using machines with paper printouts is the only way to guarantee fair elections and accurately recount ballots in a close race.

The lawsuit, which is back in court for a hearing on Friday, is considered a friendly legal challenge because the paper-ballot proposal has the support of commissioners in all three South Florida counties, including Broward County Mayor Ilene Lieberman.

The perception that it was none of his damned business since he happened to be uncontested this time didn't enter into the situation only 6 months ago!
