The shooting happened around 3:20 p.m. just south of Vista Point after a California Highway Patrol officer pulled over a motorist for tailgating, said Officer Jason Butler, CHP spokesman. The names of the driver and the officer involved were withheld, pending an investigation.
"The driver had an issue with being issued a citation. He exited his vehicle on the freeway and attacked the officer," Butler said, noting the man had no warrants or criminal history.
The officer reached for his baton in an attempt to defend himself, but it became lost in the scuffle and the officer was struck on the head. The CHP is investigating whether the officer was struck with the baton.
Bleeding substantially, the officer drew his weapon and shot the suspect at least two times in the upper body.
