Davis, ACLU sue over California recall vote

SACRAMENTO, Calif. - Gov. Gray Davis says counties will disenfranchise thousands of voters by opening fewer precincts during the Oct. 7 recall election, but election officials say opening all the polling spots would risk chaos because of a shortage of poll workers.

Across California, county voting officials plan thousands fewer precincts for the special election for which they had only 77 days' notice to find voting places and hire poll workers. (snip)

(snip) Voters who have to travel to new polling places are more likely to encounter crowds, confusion and delay, and are less likely to vote than voters who can vote at their normal polling places," says the Davis lawsuit. It states that African-Americans, Asian-Americans and Hispanics will be "disproportionately denied the right to have their votes counted."

History shows such urban voters are more likely to vote Democratic.

...give Davis standing here? I mean, according to Scalia's logic, the Equal Protection amendment means that every voter in every county must have the same opportunity to have their votes count as every voter in every other county of a state. If certain large counties (like mine, LA) don't have the funds to properly staff polling places, doesn't that mean voters in LA County won't have the same opportunities to cast a vote as say a voter in a smaller county that won't have polling place issues?

I'm no lawyer but I think Davis has a case. And it would be sweet justice to have Bush v. Gore thrown back in the shithead's faces. If it goes to Federal Court, we know the 9th Circuit will be on our side, and I'd be shocked if the Supremes would want to revisit their most embarrassing moment since Dred Scott.

haha. maybe this is why Scalia threw in the clause that this decision shouldn't count as judicial precedent. I wonder if the "Do as I say, not as I do" mantra of the GOP would give them cover in this.
