Fake ID card at center of abortion clinic suit

By RON NISSIMOV
Copyright 2004 Houston Chronicle

Cherise Mosley Hughes wept Monday as she told jurors that she used a fake ID to get an abortion while she was a minor because she didn't want to break the heart of her father, a Pentecostal minister.

Hughes, now 21, and her father, Fredrick Mosley, are suing Aaron Family Planning Clinic of southwest Houston and Dr. Douglas A. Karpen for accepting the fake identification card and performing the abortion in August 2000 without notifying Mosley.

The doctor and clinic are accused of violating Texas' 1999 parental notification law requiring that minors' parents be notified 48 hours before an abortion.

Hughes and Mosley contend that clinic workers would have realized Hughes was a minor if they had questioned her about the ID, which states that it is not a government document. They testified that if this had been done, the abortion would not have been performed because Mosley would have reassured his daughter that he loved her and would have advised her to keep the baby.

"He would have shown me how to take care of the child," Hughes said while being questioned by her lawyer, Jared Woodfill. "I think about the baby every day. My (other two children) could have had another brother or sister; I don't even know which it was."

She and her father are seeking unspecified damages.

3. Incredible stupidity.
She made the decision to get her uterus scraped. She went to the trouble of procuring fraudulent identification to deceive the clinic into believing she was of age for the procedure. She regrets it now, that's too bad. The choice was hers.

And Ms Hughes should be the one on trial here...criminal misrepresentation for the purpose of obtaining regulated voluntary medical services.

The incredible number of brain-damaged fuckwits in the world is making me wonder if we oughtn't make abortion mandatory.

6. Shields up!
You are gonna get it big time.

My question is why does this 21 year old have two other children (plus being pregnant once before) at such a young age? Yes, it's her life, but it doesn't appear anyone is giving her good advice if she is choosing to have so many children so young when she apparently isn't mature enough to make her own decisions. Whose decision is it to sue I wonder?

Why don't these people use birth control? I knew about it when I was 17 and I knew where to get it. Granted that was a "few" years ago, but are clinics now not giving out pills or other bc devices?

8. Wouldn't this fall under the category of frivolous lawsuit?
Where are the Republicans now to fight off this abuse of our judicial system?

12. From The Referenced Article
Hughes, who later had two other children with the father of the aborted fetus and then married him, was seven weeks shy of her 18th birthday when the abortion was performed.

She testified that the father, Reynaldo Hughes, wanted the abortion and helped her get a fake ID at a Fiesta Supermarket.

Hughes said she lied about her age and address and that no one at the store or the abortion clinic questioned her about the ID.

Real "family values" folks here. Wonder why she isn't on "Jerry Springer".

13. If we can convict a 15 year old of murder as an adult, we can
certainly hold a 17-year-old responsible for criminally obtaining a false ID. Kids that age either know what they're doing, or they DON'T! The repukes, and their right wing judges, can't have it both ways.

:argh:

15. This is outrageous
I personally have had an abortion at this same clinic, several years ago. It is known as the most professional clinic in Houston, and one of the most expensive as well. The staff there are courteous, compassionate, and understanding individuals. Because some almost 18 year old (only a few weeks shy of her 18th birthday!) presents a fake ID to obtain an abortion that she CHOSE TO HAVE, they get sued?

Also, lets do the math. She was nearly 18 when pregnant with her first child. She is now 21 and has two more children. She has been almost continuously pregnant since age 17.

I really have to question parents who raise their daughter to be so irresponsible in regards to her own body and life. I bet she'll find herself divorced with two kids to support (and probably no education or job experience) in the not-to-distant future.

16. So, how many years later are we suing? /coughs
If anything, SHE should be charged with forgery and her NOW husband! THEY are the ones who made the mistakes here...NOT the abortion clinic.

I think some Rethug has them in their pocket to make a point..pass a bill.. further a cause or something because this totally takes the eye off the person who committed the criminal act and puts it onto the one providing the service.

If it was alcohol instead of an abortion or say a prescription or something that required ID and they did the same thing...who would be the one being charged?

The person who FAKED the ID!

17. So if I commit fraud, and then
later on show remorse, the entity on which I perpetrated my fraud should compensate me for victimizing them?

That doesn't even begin to make sense to me. Did I miss something here? The law doesn't require clinics to get a government issued ID from the patient. Basically, this nutcase admits to fraudulently obtaining ID that showed her to be of age, using it to commit fraud, and then suing the clinic for accepting what it reasonably couldn't have known was fraudulent ID, because they aren't required to get government issued ID from the patient. My local doctor accepts my insurance card as ID, and IT isn't government issued either. If this whackjob wins, does it mean we'll have to get government issued insurance cards with our DOB and photo on it?

18. Maybe this government issued ID card is WHAT they are after...
and using this as the case to push it through. There has to be something else behind this because otherwise it doesn't make sense.

NOTE: It still doesn't make sense, but at least it points to the madness behind it.

19. Okay so she didn't listen to her dad's teachings
...and I am sure pentecostal ministers preach against sex outside marriage....and then she broke the law by using a fake id...and then she expected the people she presented the id to ...to know it was a fake...and now she is suing because hindsight being 20/20 she now realizes that her illegitimate child would be accepted by dad...

Clearly she was old enough to be having sex....she made a choice to do that...then she chose to have the abortion..even going to the trouble of getting a fake id.... and now....she thinks the clinic is responsible????

21. Anything for money!!!
That is the most idiotic, immature, greedy-ass thing I have ever read. She should be evaluated for her mental health.. and dismissed as a greedy loser. SHE should be arrested for using false ID. Perhaps the clinic should sue her. UNBELIEVABLE!!!!!!!!!!!!!!!
