Enemy combatant case back in court (Jose Padilla)

CHARLESTON, S.C. — Attorneys return to federal court in South Carolina to ask that the designation of a man as an enemy combatant and his subsequent treatment at a Navy brig be declared unconstitutional.

The government wants the suit dismissed and attorneys for both sides appear before a judge in Charleston on Monday.

Attorneys for Jose Padilla sued former Defense Secretary Donald Rumsfeld, Defense Department officials and officers at the brig in Hanahan in 2007.

They allege Padilla, arrested in 2002, was unlawfully held as an enemy combatant. His attorneys say during 44 months at the brig he was at times kept in total darkness and isolation, deprived of sleep and kept from family and attorneys.

There is no justice...not in America. How can the government fight against this man's case? His treatment was certainly an abuse of his basic Constitutional rights. Holder and Obama need to get their act together. If this man were one of their own children, would they be against his suit? That is the criteria that needs to be used from this day forward.
