'Second underage girl' named in Berlusconi sex case

'Second underage girl' named in Berlusconi sex case
Source: BBC

A second 17-year-old girl has been named as taking part in what prosecutors allege were sex parties held by the Italian prime minister.

The girl, named as Iris Berardi, was known to police as a prostitute, Italian reports say, and attended one of the events days before turning 18.

The details have emerged from new documents submitted by prosecutors on Wednesday to a parliamentary committee.

Mr Berlusconi says the allegations against him are politically motivated.

3. Got it. I only asked because I read an article the other day in the paper..
That mentioned my state's age of consent is 16, I was shocked. I always assumed it was 18 everywhere.

7. In Colorado it may be age 12 to thsi day, was the rule in PA till the late 1990s.

Until January 1, 2005, Pennsylvania recognized Common Law marriages. Common Law Marriages could no longer be entered into after January 1, 2005 (Through if you entered on before 1/1/205 it was still valid).

The appeal movement started in the late 1990s when a teacher was accused of having sex with one of his 12 year old female students. At trial his defense was he and the girl and entered into a Common Law Marriage and thus the sex was between consensual spouses. Sex between consenting spouses is always legal, no matter the ages of the spouses. The case went all the way to the Pennsylvania Supreme Court, which ruled that since Pennsylvania recognized common law marriages, AND has never address the age when one can entered into such a marriage, the Court had to look at what was the English Common Law rule. The English Common Law rule was that a 12 year old could agree to sex or marriage and thus the sex between the 12 year old student and her teacher was legal sex between spouses. Under the Common Law a 12 year did NOT need her or his parent's permission to entered into such a marriage, and since the State Legislature had never addressed Common Law Marriages at all, that remained the rule in Pennsylvania (Until it was changed right after ward to the rule anyone entered into any marriage had to be 18, and then the abolishment of Common Law Marriage effective 1/1/2005).

Colorado is another state that uses the Concept of Common Law Marriage similar to the old rule in Pennsylvania. While it is illegal in Colorado to entered into a ceremonial marriages without your parent's permission until you are age 18, the stature does NOT address Common Law Marriages and as such the rule may be that a 12 year old can entered into a Common Law Marriage in Colorado to this day.

Other states it is less clear, many forbid any marriages (a ban that would include Common Law Marriages) unless you have your parent's permission (or you are over 18). Commentators have mentioned Colorado for it rules on Common Law Marriages were the most similar to Pennsylvania's.

Anyway as to sex OUTSIDE OF MARRIAGE, the rule in Pennsylvania is you can not have sex with anyone under age 16 UNLESS you are within four years of age of the person below 16, then the age limit is 14.

10. Of course not.
But I am more outraged by 11- and 12-year-olds being plucked from their homes to service a dictator than the fact that a 17-year-old is a prostitute in Italy.
