Alito refers 'birther' attorney Taitz's request to Supreme Court

A request to U.S. Supreme Court Justice Samuel Alito by "birther" attorney Orly Taitz asking that $20,000 in sanctions against her be reversed was referred on Tuesday to the entire court.

U.S. District Court Judge Clay Land imposed the sanctions last year after he warned her and then gave her a time limit to explain why he shouldn't fine her in the September 2009 case of Capt. Connie Rhodes, who questioned the legitimacy of Barack Obama's presidency.

Taitz appealed the sanctions to the 11th Circuit Court of Appeals in Atlanta. That court upheld the sanctions in March, and Taitz sent an application for stay to U.S. Supreme Court Justice Clarence Thomas on July 8. Thomas denied it a week later.

Taitz then refiled it with Alito on Aug. 4. That request was referred on Tuesday to the entire nine-member court, the Supreme Court's website states.

4. It's a normal procedural thing. No need to infer anything from it.
Alito is a winger but I don't think he's a birfer. If the entire court rules against her on the sanction question that's a good thing, and maybe Oily Taint will STFU, at least for awhile.

30. Utter fail.
The Supreme Court need not take this up at all. There's thousands of cases with much more merit that they turn down every year. They don't have time for this bullshit.

Alito's an asshole and a lot can be read into this.

It's NOT a normal procedural thing.

10. All this does
IMHO is give the wing nut birfers a sense that they have some credibility. I suspect they are cheering and applauding this on the wingnut websites and taking it as some kind of victory.

From what I can figure, this is more about her paying the fine than it is about the authenticity of Obama's BC.

Even the wingers on the court have got to be sick of this shit, and probably recognize that if they don't basically shut this crazy fuck down, and I mean right now, come 2012, every bugfuck pseudo-attorney is gonna file multiple birther challenges to every court they can find....

Orly may just set a judicial precedent of a 9-0 decision ordering the Marshalls to collect some cash....

The Court and Congress Expected the Other to Resolve the Obama Eligibility Question
On Thursday, April 15, 2010, Hon. U.S. Supreme Court Justice Clarence Thomas was giving testimony before the House Appropriations Subcommittee on the issue of the composition of the United States Supreme Court. The hearing was broadcast on C-Span. Subcommittee Chairman, Rep. Jose Serrano, D-NY (now the most senior Member of Congress of Puerto Rican descent), and he were having a pleasant exchange. Rep. Serrano was explaining to Justice Thomas how he feels “a little uneasy” despite much of the dismay of his friends on the “left” about having a hearing for the Supreme Court because of the respect that he has for the Court. He added that it was “humbling” but that the public understood the importance of what the Court does and the impact that it has on the future of our country. Justice Thomas thanked Rep. Serrano for his words. Rep. Serrano then jumped in and commented on Justice Thomas’ view on who can sit on the Supreme Court. The following exchange occurred:

Rep. Serrano: I’m glad to hear that you don’t think that there has to be a judge on the Court because I am not a judge. I have never been a judge.

Justice Thomas: And you don’t have to be born in the United States. So you never have to ask, answer that question (smiling).

Rep. Serrano: Oh, really?

Justice Thomas: Yeah (the audience laughing).

Rep. Serrano: So, you haven’t answered the one whether I can serve as (Justice Thomas interjecting) President but you answered this one (smiling).

Justice Thomas: We’re evading that one (laughter from Justice Thomas and the audience). We are giving you another option (more laughter from Justice Thomas and the audience).

Rep. Serrano: Thanks alot.

Justice Thomas: Thank you, Mr. Chairman.

The nutjob bringing this case filed an emergency petition for stay with the Justice assigned to circuit from which the case originated. That Justice was Thomas, and as is almost always the case with this sort of emergency petition, he denied it. The nutjob then, as permitted by the SCOTUS rules, re-submitted his petition to another Justice, namely alito, who, following standard practice when a once-rejected emergency petition is re-filed, referred the matter to the court for consideration at its regular conference. It really wouldn't have mattered which justice the nutjob went to second -- even if she had gone to Ruth Bader Ginsburg, the result would have been the same--kicked it to the conference so it could be disposed of once and for all.
