3. SENATE APPROVES KAGAN TO THE SUPREME COURT

By a vote of 63-37 the Senate today approved U.S. Solicitor General Elena Kagan as the 112th Justice of the Supreme Court. With the confirmation process complete, Kagan will next go to the Supreme Court to take the Constitutional Oath and the Judicial Oath, both to be administered by Chief Justice John Roberts.

Nebraska Democratic Senator Ben Nelson was the only member of his party who opposed Kagan in the final vote. Five Republican Senators joined the Democratic majority to support the nominee: Susan Collins (ME), Lindsey Graham (SC), Richard Lugar (IN), Olympia Snowe (ME) and Judd Gregg (NH).

Kagan will replace retiring Justice John Paul Stevens and become the fourth female Justice in the Supreme Court's history. For the first time in its history, he nine-member court will now have three sitting female justices.

Two more women and they will have a majority.
The state court I practice in front of has a panel of four women and one man. The man and two women are Ds and the other two are Rs.

8. And Brown from MA goes into this nauseating spiel
about why he opposes Kagan. I am glad I wish he continues on his path. Cause the people of MA are going to kick this guy out when he runs for re-election. They don't want someone with their head up republican ass they want someone who will look out for their interests. He is stupid to follow republican lemmings. If he wants to get re-elected he will do the right thing, and since he isn't I hope he gets plowed under in the landslide coming for his re-election .

Today, by a vote of 63 to 37, the Senate approved the nomination of Elena Kagan to the Supreme Court. People For the American Way President Michael B. Keegan issued the following statement:

“Americans should be proud that Elena Kagan was confirmed to the Supreme Court today. She brings to the bench sterling credentials and a formidable intellect. Her commitment to the Constitution and equal justice under law will serve the Court well in the decades ahead.

“During her hearings, Elena Kagan spoke powerfully about the Constitution as a timeless document, constructed by its framers to be interpreted over time in light of new situations and in new contexts. She articulated a view of the Constitution and the role of judges in sharp contrast to Chief Justice Roberts’ misleading analogy to an umpire calling balls and strikes. Solicitor General Kagan made clear that she has the intellectual fortitude and the command of the law to keep faith with our Constitution--its amendments, its history, and its core values like justice and equality under the law.

“Thanks to today’s vote, the Supreme Court will have three female Justices for the first time in our nation’s history. This is an historic step forward for all Americans, and an advancement of which every citizen should be proud.”

Excerpts from the Court's announcement about plans for Kagan's introduction into the Court follows:

Elena Kagan will be sworn in as the 100th Associate Justice of the Supreme Court on Saturday, August 7, at 2 p.m. at the Supreme Court of the United States. Chief Justice John G. Roberts, Jr., will first administer the Constitutional Oath in a private ceremony in the Justices’ Conference Room attended by members of the Kagan family. The Chief Justice will then administer the Judicial Oath in the West Conference Room before a small gathering of Elena Kagan’s family and friends.

The Judicial Oath ceremony in the West Conference Room will be open to pool coverage. There will be no opportunity for interviews or questions at the ceremony.

A formal investiture ceremony will take place on Friday, October 1, at 2 p.m. at a special sitting of the Court in the Courtroom.
