Senators McCain And Lieberman Introduce Bill To Authorize Indefinite Detention
March 4, 2010
Legislation Would Also Create New System Of Interrogation

FOR IMMEDIATE RELEASE
CONTACT: (202) 675-2312 or media@dcaclu.org

WASHINGTON – A bill introduced today in the Senate would hand the government the power to indefinitely detain terrorism suspects without charge or trial, dealing a swift blow to due process and the rule of law.

The Enemy Belligerent Interrogation, Detention and Prosecution Act of 2010, introduced by Senators John McCain (R-AZ) and Joseph Lieberman (I-CT), would also create an entirely new system of interrogation by requiring intelligence officials to be consulted about how to handle terrorism suspects after their capture. The bill was precipitated by misguided objections to the Obama administration’s correct decision to charge accused Christmas Day attacker Umar Farouk Abdulmutallab in the criminal court system. The legislation would have a “high value detainee” team, made up of members of different intelligence agencies, interrogate and determine whether alleged terrorist suspects are “unprivileged enemy belligerents.” If so, and if the suspect is then charged, the legislation would mandate the use of the discredited and unconstitutional military commissions.

The American Civil Liberties Union vigorously opposes the Enemy Belligerent Interrogation, Detention and Prosecution Act.

2. Reminder: PATRIOT ACT II allows the government to strip any individual
of one's citizenship, making anyone an enemy combatant. And if this bill passes, you're stripped of the right to civilian courts.

18. Thank you
Sometimes I really do need to have 2 and 2 put together for me. It comes so fast it seems like it's pointless to keep track of it all.

This is exponentially evil then.

4. This would be a good step forward to catching up with ...
...dictatorships! We're getting closer, don't worry, they will protect us!

My God, McCain and Lieberman have gone, again, beyond the pale. This would make the founding Fathers retch, ...such as they were.

20. He's a Wuss
he told the North Vietcong everything he knew and then some and at the detriment of his fellow prisoners. You see in SERE school we taught and prepared the pilots for the day they may be shot down and captured as 'bad pilot' here was taught. The lesson didn't take with him though. To my knowledge no one who graduated from our school, except for mcCain if he actually went, broke down after being captured. Something tells me that his papers showing where he graduated the SERE school is fraudulent. I say family ties was his graduation papers

29. Perhaps McCain was brainwashed in North VietNam and thinks
totalitarianism is a better system. His legacy gets smaller and smaller by the day. It's a shame that as some people get older they forget why they fought for freedom and democracy and only think of control and how to get around the Constitution rather than preserve and protect it. Shame on McCain and Lieberman.

11. What exactly are they trying to achieve with this bill?
They have to know that it will never pass, and I find it hard to believe that they would even want it to. Are they just trying to score some points with the tea baggers maybe?

Actually ... I would consider the tea baggers “enemy belligerents”.

Seriously, did they leave that out? You know they probably both wanted it. This whole thing is totally sickening.

who boasted on national television that he bombed innocent women and children, what do you expect? I'm still trying to figure out how he isn't in a jail somewhere?

In any way shape or form. Anyone that passes such asinine laws needs to be put into indefinite detention immediately.
