Apple wins iPod hearing loss lawsuit

AFP - A US appeals court on Wednesday upheld the dismissal of a class action lawsuit filed against Apple Inc. which claimed the iPod was defective and could cause hearing loss.

"The plaintiffs simply do not plead facts showing that hearing loss from iPod use is actual or imminent," the San Francisco-based US Court of Appeals for the Ninth Circuit said in upholding the ruling of a district court.

The suit against Apple was filed by Joseph Birdsong of Louisiana and Bruce Waggoner of California. They claimed the iPod "is defective because it poses an unreasonable risk of noise induced hearing loss."

Birdsong and Waggoner said the iPod is capable of playing music as loud as 115 decibels and users may listen at unsafe levels.

1. whatever happened to personal responsibility?
i assume adults purchased these ipods. lawsuits like this nonsense give lawsuits in general a bad name.and don't get me started on the greed and avarice ofthe lawyers looking for a payday.

3. Products have to have "moron-proof" labels these days
Ipod probably does come with something like "Warning--if you turn this product up to uncomfortable levels of volume you may cause hearing loss".

4. They do
and when I turn mine up to 11 for a few minutes at a time, it's my understanding, even without the verdammt warning, that I'm blowing my ears out and possibly causing permanent damage to myself. Apple has nothing to do with how much I headbang on any given day.

13. OMGSH, is that really a warning somewhere?
I hope it is!

My Playstation II came with a picture of a child using the plugged in Playstation in the tub as a bath toy and said "do not use while in the bath" or something to that effect. I took a pic with my camera phone it was so ridiculous.

14. Yep, or it at least was a few years back
My personal favorite is still "Knife is sharp; keep out of children," though that one was a bit more obviously meant in jest. ;)

9. I have owned many iPods and two iPhones. The first thing I do is give away the stock earbuds.

And reach for my in-ear headphones. They seal out outside sound so you don't have to turn up the music so much.

I got a pair of 'Ultimate Ears 700's from Santa this year.

They are awesome.

24-hour urinalysis collection bottles (gallon jugs with EDTA in them; you collect all the urine you pass over a full day's timespan then drop it off at the lab for testing) bear a label: "URINE. Do not drink the contents of this container."
