Gays Take Marriage Battle to New York Courts

NEW YORK (Reuters) - A New York gay couple on Friday sued for the right to be legally married in the state, sending the same-sex marriage issue to a New York court as the movement picks up steam around the country.

Daniel Hernandez and Nevin Cohen, backed by gay rights advocates Lambda Legal, sued New York City Clerk Victor Robles in State Supreme Court to ``challenge their discriminatory denial of a license to marry,'' according to the complaint.

New York gays hope to win their court battle based on a provision in the state constitution that guarantees equal rights to all people.

``When gay couples cannot marry, they are not treated equally, and we believe New York courts will see that,'' said Susan Sommer, lead counsel in the lawsuit.
