Nevada court considers releasing O.J. Simpson
Source: MSNBC.com

LAS VEGAS - Three Nevada Supreme Court justices are considering whether to let O.J. Simpson and a former golfing buddy out of prison while the full court reviews their convictions for a gunpoint hotel room heist.

Justice Michael Cherry didn't say at the end of a hearing Monday how long it will take for the three-member panel to rule on whether the former football star and convicted co-defendant Clarence "C.J." Stewart should be allowed to post bond.

4. Did OJ get a bum rap in Las Vegas because he got away with murder in LA?
There is a school of thought that this is the case. There is no doubt about his guilt in the Vegas case, but the question has to do with the severity of the sentence.

The judge was pissed that he beat the rap in the murder trials so she threw the book at him when it came to sentencing.

I don't know if this is the case or not but if it is, it's wrong. Yes, Simpson is a thoroughly repulsive human being, and yes, he probably did commit the crime he was acquitted of in 1995. That has nothing to do with his Las Vegas charges. The system means nothing if someone gets sentenced for their reputation.

6. He's claiming he didn't get a fair trial, not that his sentence is unfair.
And I didn't see any evidence of that, did you?

12. Well, I guess he could be claiming that the sentence was what was unfair about the trial
But in response to your question, no, I don't think there is any question about his guilt. Ample evidence of his culpability was presented at trial.

And I reiterate, I cannot prove or disprove the hypothesis that he got a harsh sentence because the judge felt he walked on the charges of murdering his wife.

All I am saying is, if that is the case, it is unfair. And even a slimeball like OJ Simpson deserves fair treatment from our courts.

8. Had OJ been convicted on...
...drug charges we would not be having this conversation as he would be serving his entire term regardless of the fact he got away with murder...Only in the USA can you ask for forgiveness in violent crimes & armed robbery but don't even think about it if you have been convicted of a non violent drug offense!

15. O.J.s sentence was at the LOW end of sentencing guidelines
he was facing a much tougher sentence than he got. He could have received a life sentence on the kidnapping conviction alone. I don't think he has a legitimate complaint about the sentence.

I doubt the court will release him pending appeal. That is very unusual in Nevada.

23. Fact is he was overcharged- and the filings weren't based on the present actions
but rather on the widespread perception that he got away with murder in another case.

Edited on Tue Aug-04-09 01:59 PM by depakid
Yep. That's the reality.

Of course, most Americans have such little regard for the integrity of the criminal justice system that things like this don't bother them (unless it gets in the way of their pound of flesh in the case at hand).

Part and parcel to why you built and maintain the world's largest and most expensive prison system, cling to capital punishment- and so easily became a nation of torturers, who disregarded international laws and treaty obligations.

Simpson clearly thinks the law doesn't apply to him -- and no wonder.

14. Sort of a Misleading Headline

His lawyers are asking the Nevada Supreme Court (there is no intermediate appellate court in Nevada) to free him on bond while they argue that his conviction was improper, because he should have been tried separately from his co-defendant. So, "Nevada court considers releasing Simpson" is technically true, but if it happens, it would be an extraordinarily rare action by the court. And the consideration of the conviction is another matter entirely.

28. Exactly

It's a stupid argument with (IMO - - I'm not admitted in NV) a very small chance of success, and the headline (no doubt deliberately) oversensationalized it.

29. not parole.
OJ is asking to be released on bail until his appeals are considered by the court. This would be extremely unusual. OJ wants special treatment which nobody else gets.

He was sentenced to a minimum of 9 years.

The last time the Nevada Supreme Court granted such a request was in 1978. It was a child molestation case. After being released, the guy fled and has yet to be caught.
