Washington Post reporter Tim Craig relays that the D.C. Council has voted 13-0, without debate, to recognize same-sex marriages performed in other states. Watch D.C. Wire for updates.

Attorney Mark Levine said his analysis of District law found that the same-sex marriage question cannot be put before voters. He noted that local election law forbids a vote on a matter that violates the District's Human Rights Act. The act states that the government cannot "limit or refuse to provide any facility, service, program, or benefit" to any individual on the basis of sexual orientation.

needs to start proceedings to remove him.

"UPDATE: D.C. Council member Marion Barry (D-Ward 8) has now asked that the gay marriage bill be reconsidered. He didn't realize what he was voting on before.

He just gave a speech saying he is going to vote against it so it won't be unanimous vote. The council is now debating the bill."

They have to debate it again beause he asked for another vote?

Clearly, the lunatics are running that asylum.

Seriously, this is great for the the DC Council to do, but the paradox is maddening.

And, now that Obama has taken overthrowing DOMA off his agenda, it's probably the best we can hope for.

D.C. Gay Marriage Measure Set for Mayor's Signature
Council Votes 12 to 1 to Honor Other States' Same-Sex Unions

Tuesday, May 5, 2009; 12:10 PM

An overwhelming majority on the D.C. Council voted today to recognize same-sex marriages performed in other states, sending the District deeper into the national debate and galvanizing supporters on both sides of the issue.

The measure, approved by a vote 12 to 1, now goes to Mayor Arian M. Fenty (D), a supporter of gay marriage.

If Fenty signs it, the District will put the same-sex marriage issue directly before the Congress. Under Home Rule, the District's laws are subject to a 30-day congressional review period.

After the vote, a large crowd of opponents, led by local ministers, began yelling "Get them off the council!" referring to the members who supported the measure....
