James J. Smith, who for nearly two decades acted as an FBI handler for Chinese-American informant Katrina Leung, was accused in the indictment of concealing the affair during a security investigation.
The 60-year-old former FBI agent, who is also charged with mail fraud and gross negligence with national security material, could face a maximum of 35 years in prison if convicted at a trial.

The new indictment accuses Smith of lying to an FBI agent during an August, 2000 security investigation, saying among other things that "he was not concealing any activity or conduct which could be used to influence, pressure or compromise him in any way..."
