Coleman asks more time for appeal
Source: Minneapolis Star-Tribune

Norm Coleman today proposed a more leisurely schedule for his election appeal than Al Franken wants, asking that oral arguments in the case be held no sooner than mid-May.

In a document filed this morning with the state Supreme Court, Coleman's lawyers asked to have until April 30 to file their opening brief. They would give Franken's lawyers about 10 days to submit their brief, and then would plan to file their reply by May 15.

"Appellants agree this is a time-sensitive case that should be resolved as expeditiously as possible. Appellants respectfully submit, however, that the parties, and the Court, must be given enough time to fully develop and consider the issues on appeal," Coleman attorney James Langdon wrote.

On Tuesday, Franken's lawyers proposed a speedier schedule: Coleman's opening brief by Monday, the Franken brief by May 2 and the Coleman reply by May 4, followed shortly by the oral arguments.

IT'S time for Norm Coleman to concede ...

Having lost a recount of the 2.9 million ballots cast, Mr. Coleman sued under a state law that merely required a three-judge panel to determine who got the most votes and was therefore entitled to an election certificate ...

By most measures, that unanimous opinion would seem to decisively conclude the long-running dispute, but Mr. Coleman isn't letting statesmanship rule. His lawyers promptly announced they would take his fight to the Minnesota Supreme Court, which could mean weeks more of delay.

That amounts to thumbing his nose at weary Minnesotans, eager for the seemingly interminable race to end so they can have their requisite representation of two U.S. senators. Even Republican newspapers are urging Mr. Coleman to give it up.

This could go to SCOTUS only to have SCOTUS say the constitution does not allow us to determine the winner of a Congressional race. Only Congress can do that.

Coleman is doing this so that Franken can not be seated and therefore, hold up the 59th seat in favor of Pres. Obama. The GOP at this time care more about their party than the State or the American people.

We know if the tables were turned, Coleman would be there as a Senator right now because the hypocritical GOP would be screaming bloody murder accusing the Democrats of being un-American.

Because as things are now, there's no downside, no penalty, and no risk at all for Coleman to keep his legal challenge shambling along. "Oh, Coleman will concede when this happens, or when that happens." No, Coleman won't concede at all, and Minnesota state law doesn't seat a certified election winner as long as a challenge is still alive. Now, if there was a way to allow for provisional seating of the winner certified by the Board of Elections, Coleman probably couldn't attract the funding and the donations necessary to keep this challenge going. But as long as the seat remains officially vacant, Coleman and his donors have no incentive whatsoever to terminate their challenge.

The Minnesota legislature can't do a thing about this situation, but maybe it could enact a law that allowed for provisional seating of a certified election winner, hmmmm?

31. I recommend that the people/congress of Minnesota
draw up an amendment that the elected official be allowed to serve for their full term based on when they actually are seated and not just when elected. That way if norm wants to pursue this until the next election, Al would still be able to serve as their Senator for six years after that and then they can hold the next election.

I suppose it varies from state to state, but doesn't the loser in a recount become the responsible party for the costs?

Because considering how much time is being wasted, it sure seems inefficient and pathetically slow.

I've seen Minnesotans defend the process and I suppose it's been transparent, but it has dragged out way too long and the MN supreme court seems to have no problem with it.

It's time to tell Norm that he isn't going back to DC (well other than to be some smarmy lobbyist bastard, a gig for which he's already lined up).
