2. No "irreparable harm"!

SAN FRANCISCO (AP) — Gay and lesbian couples won another reprieve Friday when a judge declined to immediately stop San Francisco from granting them marriage licenses, saying conservative groups failed to prove the weddings would cause irreparable harm.

The judge suggested that the rights of the gay couples appeared more substantial than the rights of Californians who voted for Proposition 22, which defined marriage as between a man and a woman

The judge did agree to consolidate two separate cases challenging the marriages and did say the groups have a right to a hearing on their argument that San Francisco is violating state law.

23. I remember the weekend before the vote on prop 22
Edited on Fri Feb-20-04 07:45 PM by Mountainman
Two women were at the local Albertsons handing out leaflets against the proposition. The leaflets said something like, we are a lesbian couple, we are your neighbors, our kids go to school with your kids, we work everyday and pay our taxes and support our community. All we are asking is to be treated as equally as you treat other people.

I felt so proud of their bravery and told them so.

4. Gutsy Judge....
IF we don't get Bush* out, these fair-minded courageous judges will be an extreme rarity.

22. Wrong
He's not a gutsy judge - he is simply being just as all judges should be. If that holds true with all other judges that will hear this then I suspect San Fran will win. (as they should, both under constitutional law AND ethically)

31. I'm not saying the law was in question.....
but how many Bush appointees do you think would have denied the stay?

So, yes, although we'd like to think this was a matter of course and something we should be able to expect from our judges, the fact is that is no longer true. This judge held his ground moral and ethical. In the context of current politics, that IS a gutsy move.

Judge Denies Immediate Stay of Gay Unions

By LISA LEFF
Associated Press Writer

SAN FRANCISCO (AP) -- Gay and lesbian couples won another reprieve Friday when a judge declined to immediately stop San Francisco from granting them marriage licenses, saying conservative groups failed to prove the weddings would cause irreparable harm.

Judge Ronald Evans Quidachay denied the Campaign for California Families' request for a temporary restraining order but said the group did have the right to a hearing on their argument that the city is violating state law.

The conservative group argued that the weddings harm all Californians who voted in 2000 for Proposition 22, which defined marriage as between a man and a woman.

The judge suggested that the rights of the gay and lesbian couples appeared to be more substantial.

16. Great news!
I've been watching the news, and have been struck with how joyous the couples being married have been. One thing I have discovered, in seeing the rightwing arguments against same sex marriage, is that they are completely hung up on the sex part.

Apparently, they imagine what gay sex is like, don't like it, and try to stop it. From my point of view as a hetero woman, marriage is so very much more than sex. It's a committment, it's caring, it's sharing your life with another person. It's being there in good times and bad; it's taking vacations together, starting a family together, making a home, and in general just doing what any other person does, live a life that is shared with another.

The rightwing fundies are so swrewed up, they view everything with an unhealthy obsession over other people's lives. Because they don't approve of same sex relationships, they want to deny that right to others. The same goes for abortion rights, minority rights, separation of church and state, the list goes on...if they don't approve, then they think their disapproval should be the determining factor.

We need to get these vicious, hating people out of office. They are ruining our country.

25. Well Said!!!
I concur 100%. Actually was just thinking about this this morning, the supremely arrogant way that the fundies ALWAYS think that THEY are the final arbiters of EVERYTHING in the friggin WORLD. Anyone who has different positions? The fundies see them as contemptible, and therefore, their views are CLEARLY wrong. These navel-gazers are SO insecure in their beliefs (usually because they are completely WRONG ;) that the mere existence of an opposing view violates their shallow sense of propriety. However, perhaps because their positions are so wrong, rather than arguing their views honestly (in which case they LOSE), they seek to discredit the people who hold that opposing view. Hence their only recourse to reconcile the dichotomy posed by the existence of positions opposite theirs, they must constantly engage in demonizing other groups (the old ad hominem fallacy) such as liberals, gays, women who have had abortions, atheists, etc, to make themselves feel better. It's pretty sad when you think about it. I'm so glad I base all my views on science and logic instead of NOVELS written 2000+ years ago...

People who live in the fantasy world that the religious right does should absolutely NOT be allowed into positions of power here on Earth. Period. The fundies of the USA are destroying this country just as surely as the Taliban destroyed Afghanistan. It's really quite sad that there are still people who think exactly like fascist cavemen, here in the USA, in the year 2004!

You'd think that most people by now would have discovered that almost EVERY issue has two sides to it, and that life is really all about choosing a view for YOURSELF, and allowing other people their's. Particularly when the existence of other's with different views doesn't affect your life in the LEAST, other than tweaking your insecurity about your own position(s). The intolerant, hate-filled wingnut Talibornagains are all so stupid and self-righteous that they fail to see the obvious parallels between their MO, and the MO of the Islamic Fundies that they despise so much. Even if they DID see the similarities, they'd just say it doesn't matter since 'we' are 'right' and the taliban are 'wrong' because 'our' Holy book is written by the 'real' God and 'theirs' ISN'T, so THERE. Totally oblivious to the fact that that is exactly what the taliban think about THEM, and that there is actually NO WAY to know who is actually 'right'...

PS: My MANAGER came into work on Wednesday and informed us that he and his boyfriend had gotten married at City Hall in SF on Tuesday! Everyone at work is so happy for them, they are such a cute couple and have wanted to do this thing FOREVER. Hooray, Gavin Newsom!!!

Peace Y'all!

26. Thank u Allah!
And Jesus, and Buddha, and all the rest!!! This is soooooooo cool. The freepers are burning up with hate right now. Let 'em burn I say, because the more they try to control what they don't approve of, the more they will lose.

I am flying up to San Francisco this weekend so I'll definitely take my camera over to the court house and take some pix of history unfolding.

P.S. I do have tears in my eye (as always) when I think about all of the friends I lost to AIDS who would have loved to be a part of this. I know they're looking down at us from heaven and saying, "Go girl!"

27. Not sure if it could be put any better than how the Judge put it….
I mean….It’s all about “equal rights”…not how a voting majority may feel about it…

"If the court has to weigh rights here, on the one hand you are talking about voting rights, and on the other you are talking about equal rights," Quidachay said.

28. The freepers will have to change the constitution...
...so that it allows discrimination. That's the only way they will stop this movement now.

It wouldn't surprise me if they did since homosexuals have always been at the bottom of the totem pole as far as minorities go (maybe not financially). We are perverts after all, unlike the Gropenator whose muscles are as pure as the driven snow.

...when bigots can't get courts to curtail the freedom and rights of others? What's it coming to? ;-)

You go, you gays and lesbians. Marry if you want, and good luck to you. You can't do any worse with this institution than the ridiculous majority have.
