BBV - California group wants judge to order upgrades to electronic voting

Two weeks before California's March 2 primary, a group alleging widespread potential security glitches in electronic voting machines is asking a judge to make counties install new safeguards before voting begins.

Court officials scheduled a hearing on the issue at 1:30 p.m. Wednesday, along with an accompanying lawsuit seeking to stop the state and Diebold from using ``insecure'' voting machinery. California counties are using three versions of Diebold systems to register votes and the company's software to tally them.

The new legal challenge comes as 10 counties are already balking at Secretary of State Kevin Shelley's directive to further protect Diebold and Sequoia Voting Systems machines before the primary. Shelley, expressing fears of skewed election results from software corruption or malfunctions, has ordered random testing and other extra measures to guarantee accuracy on March 2.

Diebold has consistently maintained that its voting systems are effective and safe and have accused critics of a ``multitude of false conclusions."



This suit was filed by Bev Harris, Jim March, et al, and accuses Diebold of fraud, willfull violations of state and federal election laws. The first major campaign of the war for democracy has begun.

6. What is important here
is that Diebold is FINALLY being called for willful fraud. States have avoided this despite the overwhelming evidence that Diebold knew their machines were junk and not secure.

Not only must the machines be de-certified, Diebold must refund ALL money and be prosecuted.

5. Excellent.
Its hard to believe these election officials have to be dragged kicking and screaming to protect the votes of the citizens. Placing all our hopes of democracy in the hands of todays courts is not altogether encouraging.

7. Good luck!
March 2nd is when San Diego (CA) county first uses their gee-whiz-bang-super-duper Diebold systems. The county registrar keeps insisting they're safe and accurate, and is unwilling to hear concerns to the contrary. Maybe this will help serve as a wake-up call that not everyone in the country shares her confidence.
