Reports Indicate Mass Governor May Ignore Gay Marriage Order
Reports Indicate Mass Governor May Ignore Gay Marriage Order

(Boston, Massachusetts) Massachusetts Governor Mitt Romney is reportedly considering ignoring a court order allowing same-sex couples to begin marrying in May. Among the possibilities is an executive order barring the state Public Health Department from issuing marriage licenses to same-sex couples after the Supreme Judicial Court's ruling takes effect on May 17.

A spokesperson for Romney said lawyers for the Republican governor are looking at a number of options, all within " the bounds of the law."

No decision is expected until after the Legislature resumes its deliberations on a proposed constitutional amendment barring gay marriage.

Last week two meetings of a joint session of the House and Senate failed to pass proposals and legislators will return to the issue on March 11. (story) Even if a proposed amendment is passed by the legislature it would need to be passed a second time in the next sitting of the body and the earliest it could be put to voters would be 2006, two years after the court mandated same-sex couples could marry

1. "All within the bounds of the law"
 How in God's name can violation of the Constitution of the Commonwealth of Massachusetts be "within the bounds of the law"?

I would sign a recall petition if he issues any kind of an executive order. He raised his right hand and promised to uphold the Constitutions of the United States of America and The Commonwealth of Massachusetts. He would deserve to be removed from office if he tries to act like King Mitt and order that his religious belief become the law of the land.

Disgusting, Mitt...you should be ashamed.

BTW...seen outside the State House during the con-con debates was a sign reading:
My pedophile priest is opposed to gay marriage

9. But a sense of fairness requires me to ask
What then is the difference between what he wants to do and what Gavin Newsome is doing in San Francisco.

Newsome instructed his clerks to allow marriage licenses to gays. Personally, I think it is fantastic.

However, it is clearly against state law.

How can one be jeered for following his conscience and the other praised for his?

13. Thought the state law said ssm from OTHER states wouldn't be
recognized, but there was nothing in law that applied to ssm performed in the state of CA, that's why he said the city clerks had to start issuing the licenses.

If it were strictly against the law, they would have found a judge over the holiday to order an injunction.

14. A very good question! However, sometimes you have to break the law
in order to have the constitutionality of the law reviewed by higher courts at both state and federal level. I believe that is what the underlying motivation in S.F. You must have what is called legal standing to bring a couse of action. This is how the seperate but equal laws in the south were challenged in the 60's. There were sit-ins at coffee shops and drugstore cafe counters.

However, in the case of Massachusetts, the state supreme court has already pretty much ruled on the issue. If the governor bans the marriages, it will be interesting to seeon what grounds. From a legal perspective, this is all going to be very intersting.

8. how is this "within the law"?
The Massachusetts Supreme Court was unequivocal about their ruling. How can circumventing it possibly be done within the law?

This is going to be an interesting summer here in Boston...

Edited on Mon Feb-16-04 02:16 PM by TexasProgressive
This thing is just getting started. Wait until this summer. This fucked-up country will be completely out of control over the issue of gay marriage.

Here's the really sick part. There will be another Matthew Shepard. Perhaps many more. And it's all becuase these fucking bastards are playing on people's fears and prejudices in order to win a few votes.

God Damn Romney to Hell.
