White House suffers loss in e-mail case

A federal judge has ruled against the Bush administration in a court battle over the White House's problem-plagued e-mail system.

U.S. District Judge Henry Kennedy says two private groups may pursue their case as they press the administration to recover millions of possibly missing electronic messages.

Kennedy rejected the government's request to throw out the lawsuits filed by Citizens for Responsibility and Ethics in Washington and the National Security Archive.

The Bush administration had argued that the courts did not have the power to order the White House to retrieve any missing e-mails.

Of which there are many. The GOP will be beholden to those criminals long, long after we have repaired the damage of the Bush Administration.

Someone with a conscience and a crapload of money should just buy 'em now and make them all public.

but is anyone going to be held accountable? Will this ruling be enforced before they skip town? They've broken the law before and always seem to get away with it, I wish I could say this might be any different.

26. Formatting a hard drive does NOT destroy data!
It has to be rewritten with 1s and 0s at least 7 - 15 times before the data cannot be recovered. There are companies who do this for their livelihood.

17. I noticed that right off too.
The press carrying his polluted water right to the end. Bush has stonewalled any and all attempts at getting inside information into his criminal junta. This has always included refusing, redacting or withholding information as they will. When the courts ordered the emails to be released they simply declared them lost, knowing that as always no one would hold them responsible. One more reason Lieberman has to go....along with others who refused to do their duty.

9. I cant say this enough...
e-mails are retrievable. It's VERY hard to eliminate all traces of an e-mail once it has been sent. Moreover, the same is true for hard-drives. Once information is stored, it is very hard to make it irretrievable.

In fact, there is an entire industry based on data recovery...for a reason.

A federal judge on Monday ruled against the Bush administration in a court battle over the White House's problem-plagued e-mail system. With two-and-a-half months remaining before the Bush administration leaves office, U.S. District Judge Henry Kennedy ruled that two private groups may pursue their case as they press the government to recover millions of possibly missing electronic messages.

Kennedy rejected the government's request to throw out the lawsuits filed by Citizens for Responsibility and Ethics in Washington and the National Security Archive.

The government had argued that the courts did not have the authority to order the White House to retrieve any missing e-mails.

Kennedy, an appointee of President Clinton, said the two private groups seek precisely the relief outlined in the Federal Records Act and upheld in a previous case by the U.S. Court of Appeals for the District of Columbia Circuit.

CREW and the National Security Archive want a court order directing the archivist of the United States to initiate action through the attorney general to restore deleted e-mails.
