Alaska AG suing to kill subpoenas in 'troopergate'

Alaska Attorney General Talis Colberg is suing to kill subpoenas issued by the state Legislature in its troopergate investigation of Gov. Sarah Palin.

Colberg filed the complaint Thursday in Anchorage superior court, arguing the state Senate Judiciary Committee lacked authority to issue subpoenas demanding that potential witnesses testify in the investigation. He wants a judge to rule them invalid.

The attorney general’s lawsuit against state lawmakers is the first time Palin’s executive branch has brought the courts into its war with the legislative branch of government over the investigation. Now that Palin is the Republican nominee for vice president, the stakes are huge.

Palin's husband, Todd, and two state officials have refused to honor the subpoenas, leaving some state legislators suggesting jail time is a potential consequence. Colberg’s suit is on behalf of seven other subpoenaed Palin administration officials who are supposed to testify today but won’t.

"A normal subpoena wouldn’t be voluntary," Colberg, a Palin appointee, said in a Thursday interview. "We have questions about the validity of these particular subpoenas because of how they were done."

That's all you need to know. There is NO coverage of this on any news program. So you know there is something serious to it.

Edward O'Callaghan ought to be prosecuted.


Calling herself a "raging Republican," Green says, she is "absolutely disgusted, embarrassed, and ashamed" by the McCain-Palin campaign's intervention in the Troopergate probe.

Green is alarmed by the McCain squad's use of hardball tactics and "the length to which they're going to impede and delay" the investigation. The local press conferences held by McCain-Palin aides, she adds, "are vile. They're attacking nice people, saying things that are not true. Walt Monegan has been respected in all circles. To see him used as a scapegoat is very disheartening."

Green said she is making calls and exploring whether she could call the Senate back into session to either instruct the attorney general to change his position, or to order those subpoenaed under the Legislative investigation to honor that call. Whether the Republican-controlled House would go along is another question.

7. The Palin Team May Have Just Made A Major Mistake... What If The Courts Rule Against Them?
Now that the State AG has filed this challenge to the Legislative Subpoenoes with the Courts for a decision as to their validity, they may get handed their hat and shown the door with a definitive ruling that separation of powers written into the Alaskan Constitution indeed gives the Legislature the power to issue these subpoenoes.

If they lose here, contempt for not appearing will follow, and likely jail time for Palin's husband might wake up a few MSM outlets.

I think Alaskans are pretty upset with the McCain Campaign's handling of a purely statewide issue.

Remember these are Alaskans, many Republicans, who are fed up.
