Hamburg, Germany - A Moroccan man accused of helping set up the Sept. 11, 2001, terror attacks, was acquitted yesterday by a Hamburg court whose chief judge said the trial had been seriously complicated by lack of access to intelligence agency files and al-Qaida members in U.S. custody.

Defendant Abdelghani Mzoudi was found not guilty "even though intelligence services may have information against him," chief judge Klaus Ruehle said. "One of the main problems in this trial was that it was not possible to get files from intelligence services."

<snip>

Both sides in the trial, conducted in the port city where the Sept. 11 plot was organized, have sought access to evidence from top al- Qaida members who are being interrogated by Americans at unknown locations. The U.S. government has refused to produce them, citing national security concerns.

Mzoudi is only the second person anywhere to be tried for an alleged direct role in the attacks, which killed more than 3,000 people.

Note: If, indeed, this person was involved in the 9/11 attacks, this definitely shows that the current administration has absolutely no desire to find anyone who was in on the planning of those attacks. Their "national security" card doesn't wash with the reality of their actions.

Our nation is less safe now than it was on January 18, 2000.

Ramzi Binalshibh - now in custody in Pakistan - is allegedly one of the most senior al-Qaeda members to be arrested over the past year.

US Attorney General John Ashcroft named him among the most wanted suspects within weeks of the 11 September attacks on the United States.

Mr Binalshibh - a Yemeni national - was recently quoted as saying he helped plan the operation.

Western intelligence officials believe he is the missing link - the one person who can put all the pieces of the al-Qaeda strategy into context.

<snip>

Mr Binalshibh would have been among the hijackers who carried out the attacks, had he not tried and failed four times to obtain a US visa, according to investigators.

His place was reportedly taken by Zacarias Moussaoui - the only person to have been charged in the United States in connection with the attacks.
