The Green Party is using a recent federal ruling in an attempt to get included on the presidential ballot in Ohio.
Green Party presidential candidate Cynthia McKinney and her vice presidential candidate Rosa Clemente filed a lawsuit Tuesday evening in U.S. District Court in Columbus in hopes of getting on Ohio's Nov. 4 ballot.
The party cites a July ruling by Federal Judge Edmund J. Sargus which states Secretary of State Jennifer Brunner's directive to have minor-party candidates included on Ohio's ballot is likely unconstitutional.
Sargus also determined that the Libertarian Party candidate Bob Barr and John Moore of the Socialist party should be on the Nov. 4 ballot.
The Green Party's lawsuit asks McKinney's and Clemente's names be included on the Nov. 4 ballot as well and that Brunner be enjoined from enforcing her directive, which establishes how minor-party candidates can be included on the ballot.
For example, her directive requires that people who circulate petitions for candidates must live in Ohio.
A petition from the Green Party had been rejected earlier this month because it did not have the required 5,000 signatures.
The Green Party's lawsuit has been assigned to Judge Algenon L. Marbley.
