Employer told to pay illegal immigrant's bills
Source: Omaha World Herald

German Andrade for about 15 years lifted, loaded and carried out other physically demanding jobs as an illegal immigrant.

Then came the bucket.

It crashed from a skid loader onto Andrade's left foot at a landscaping work site. Fractures led to a lingering limp, which led to back problems and, said a judge, a 45 percent loss of earning capacity. At the time of the accident, Andrade, a husband and father in his early 30s, was earning $12 an hour.

Andrade's case took a public twist when his Sarpy County employer balked at forking over injury-related workers' compensation — and Andrade took the business to court.

Good. The major perpetrators of illegal immigration are the businesses. They clearly want to exploit the hell out these workers and then have NONE of the responsibilities when it comes out of their pocket.

1. Well, of course the employer balked at paying the illegal immigrant's
workman's compensation. That's why you hire illegals. So you don't have to pay annoying things like workman's comp, social security and other payroll taxes.

4. what?!
Be more clear. Who's at fault here - the "illegal" who's trying to feed his family, or the employer who's trying to hire cheap labor?

Clarify, please.

5. Both
The employer that is hiring illegals for cheap labor that is creating a vacuum to suck illegals in.

Both are a big problem

18. Both. The illegal whose trying to feed his family shouldn't be trying to
do it illegally. The employer shouldn't be hiring him.

By being illegal the employee opened himself up for all kinds of abuse. It's sad for the family to always have to hide, and for the kids that weren't born here to find out when they apply for jobs that they can't get hired at anything much above minimum wage.

If I sneak into canada and work illegally, are you going to defend me? Would the canadians be wrong for having a problem with that. I can guess you're going to yell racism and completely miss the point.

Don't put words in my mouth.

I asked the person who posted that entry to clarify what was meant. You chose to weigh in, and to cast aspersions about my opinions in the process.

Step off.

6. I've always thought
Edited on Fri Aug-01-08 08:52 AM by JonQ
the illegal immigration problem would largely dry up if we made a concerted effort to weed out companies that employ them and fine them amounts significantly higher than they would have spent to hire an American at minimum wage.

Right now you can save a lot of money by hiring illegals and you face few risks. If you were to risk losing twice as much as you would have if you'd just hired legal workers I've got a feeling the idea of bringing in illegals won't look so appealing.

And I'd agree that both are at fault. Hiring illegals is against the law, so is coming to this country to work without permission.

All Employers of Illegals should be responsible for all of the bills.

If you hire them - You are responsible for them - Not the American taxpayers

10. What a stupid attitude!
If the employer is going to knowingly hire undocumented workers, that employer is responsible for the well-being of the worker. It's common sense! How compassionate of you.

11. There's an undocumented worker that lives on one of my family's
properties who had a very similar accident. He's lame and very young - I'd be surprised if he's thirty. His injury was made much worse because he didn't get immediate medical attention. I think his former employer is settling with him and then he plans to go home. In the mean time, he's been living hand to mouth on odd jobs that he can manage with his disability. A very sad case.

14. there are many immigrants that return home with permanent injuries
many of them US citizens go back to their native countries to start a new life with all their disabilities including the psychological scars caused by a society that diminish them as tools not as humans

companies' doctors. Delay, even physical distress was used to try to make these workers go away. I remember one lady breaking out in a sweat because they were making her do endurance tests and her pain was very bad. It was horrible and probably would have been worse if I wasn't standing there witnessing. There are some real bastards in the world and some of them are these "doctors" who work for insurance companies.

20. The way to avoid this......
Come here legally and inform the employer you WILL take taxes, unemployment compensation, workers Comp. and pay a fair wage. Then when we catch a company hiring illegals, paying them under the table and avoiding taxes immediately suspend their business license, levy high fines, and only restore their business license after they are 100% in compliance. If they get caught a second time it is a higher fine and permanent revocation of their business license. No questions asked.
