Federal judge sides with DNC in Florida delegate lawsuit
Source: Scripps

TAMPA, FL -- For the 2nd time this year, a federal judge has thrown out a lawsuit filed by a Florida democrat delegate angry over party rules that have threatened to keep Florida Delegates from being seated at the upcoming Democratic Convention.

Once again US District Judge Richard A. Lazzara ruled Wednesday the DNC did not violate any laws in stripping Florida's delegates of their voting powers.

DiMaio argued in his lawsuit that the DNC had discriminated against Florida's voters by stripping the state of its delegates after both states moved their primaries earlier than they were allowed to by the national party.

Lazzara rejected DiMaio's arguments once, but an appeals court in Atlanta sent the case back to him because suit was filed before the primary actually occurred

1. Well I hope they seat the delegates so we don't lose because the Dems in FL
stay home rather than vote, but what did they expect would happen if they went against the rules?

26. Then you know a lot of jerks.
Stupid jerks.

I am from Michigan, and I will
vote for the Democrat.

Just because my state party
"screwed the pooch" and cost
some people a rollicking trip
to Denver doesn't mean I'm dumb
enough to sit home or vote for
a Republican!

5. If people stay home instead of voting then they like how this country
is going...if it is not worth it to them to vote then so be it...I tired of hearing all this whining about their delegates...

17. When Dems act like Repugs - bad things happen
Counting votes is supposed to be a Dem value - except when it's Democrats voting?? Yeah, I can see people in FL staying home because why bother - their votes could just get stolen or not counted for the 3rd time. I disagree with that approach, but certainly understand the disillusionment that could lead someone to sit home. Dems have NEVER EVER not seated delegates before, and I guarantee you other states have broken the rules in the past.

I am someone who routinely has been contributing to Dems and Dem causes for the past 8 years, but I will not contribute one dime to the Dem party if they don't count the votes from FL. I'll vote for whoever is representing the D's in the GE, but if it's BO I will not contribute one dime since he didn't want my vote, or the votes of anyone else from FL, to begin with. He will only get my vote because there's no way I could make myself vote for all war all the time.

25. But, Obama didn't do any of this. The GOP forced the move up. It was
a GOP move. Obama just has to follow the rules. He wasn't supposed to campaign there.

I think you're blaming the wrong person.

6. Damn Liberal Activist Judges...
What possible grounds could there be to let a political party make up its own nomination rules?

I've even heard the Democratic Party makes up its own formula to determine the number of delegates each state gets, based on how many Democratic votes they produce.

They even (I've been told) let Puerto Rico vote for Presidential candidates, even though it has no Electoral Votes in November. What kind of fairness is that?

And that's what the plaintiff Vincent DiMaio gets for requesting a summary judgment--that is, he wanted the judge to rule against the DNC on the ground of, well, just because.

Edited on Wed May-28-08 04:33 PM by rocknation
because the DNC warned them that there would be consequences if they did. The DNC won't disenfranchise you unless they decide not to seat any pledged delegates at all--and I just don't believe they're going to do anything THAT stupid.
