Abortion provider must turn over files
Source: Los Angeles Times

One of the nation's few late-term abortion doctors was ordered Wednesday to turn over about 2,000 patient medical records to a Kansas grand jury investigating his practice.

Abortion opponents hope that the records will lead to further criminal charges against Dr. George Tiller, who already is facing 19 misdemeanor counts stemming from late-second and third-trimester abortions at his clinic in Wichita.

Monnat was joined in court by a lawyer from the New York-based Center for Reproductive Rights, who filed affidavits from three patients demanding that their medical records remain private.

Even though the judge ordered names and addresses removed from the files, the patients said they feared their identities could be deduced from details about their families and medical histories. The antiabortion group Operation Rescue has given the grand jury several photos that it says show pregnant women entering Tiller's clinic; the same pictures are posted online, with the women's faces blurred.

2. Medical records should not be used for this kind of witch hunt. Shred them, or just ignore

They could never attack it as a whole...so they will do it...piece by piece.
This will go to appeals...and then on to the salivating SCOTUS who will be only too happy to establish precedent on this.

9. How can this be better connected to the lie that is Pro-Life+Pro-War?
IF the issue is the sacredness of Human life, why are we drawing lines between women's bodies and society? What IS it about our bodies that makes it un-acceptable for us to kill when killing is ABSOLUTELY an ACCEPTABLE solution to other problems, e.g. John McCain.

Anyone espousing a "Pro-Life" position has serious logical weaknesses if they are also Pro-War. Ask any one of them what their solution to World Islamic Jihad is. I just don't understand why more isn't made of this contradiction legally, to force it into the open.

The unfolding legal dispute treads familiar ground.

Tiller spent three years battling a subpoena for a much smaller group of medical records sought by former Atty. Gen. Phill Kline, an opponent of legal abortion. The Kansas Supreme Court eventually forced Tiller to turn over 60 records on the condition that an independent lawyer first review them to redact names, addresses and other information not relevant to the criminal inquiry.

After Kline was voted out of office, his successor -- a supporter of abortion rights -- charged Tiller with the misdemeanors.

16. Yeah, that's what I remember.
Kline was the enthusiastic Attorney General, then he ended up out of office. This appears to be a whole new fishing expedition against the same doctor. So I guess anti-abortion groups will be going after all clinics' records so they can pore through them to see if they can cook up charges. I didn't think the law was supposed to work that way.

Kline is just as slimy as Billo. He is now our county DA and one of the local TV stations did a piece in December where they found he only worked part time and doesn't even live in this county!

I am just as excited about Phill Kline leaving office as I am about bush leaving office.

Rule on a case involving Rush limbaughs medical records here a few years ago. Some prosecutor wanted them to look for a pattern of drug abuse or prescription shopping.

One of them literally. He survived the shooting. He'll likely survive this attack, too. But some patients will likely have their identities revealed and be targeted by hate messages, or worse.

Just don't have them mailed from the office. And from different locations.

And mail fake medical records to the judge pertaining to his wife, to the attorney general pertaining to his wife, etc.
