Ex-CIA Official Wants Immunity

Thursday January 10, 2008 1:01 AM

By MATT APUZZO

Associated Press Writer

WASHINGTON (AP) - Attorneys for Jose Rodriguez
told Congress the former CIA official won't testify
about the destruction of CIA videotapes without a
promise of immunity, two people close to the tapes
inquiry said Wednesday.

Rodriguez, the former head of the CIA's National
Clandestine Service, ordered the tapes destroyed
in 2005. Rodriguez is scheduled to testify before
the House Intelligence Committee on Jan. 16.

Defense attorney Robert Bennett told lawmakers,
however, that he would not let Rodriguez testify
because of the criminal investigation into the case.
Without a promise of immunity, anything Rodriguez
said at the hearing could be used against him in
court.

The discussions were described to The Associated
Press by two people close to the case who spoke on
condition of anonymity because the talks were to
be private.

4. He'd better roll on a few high level people in exchange
for immunity, preferably ones in the White House. If his immunity is the price of truth, I say it's worth it.

6. As much as I would like to see
EVERYONE involved in this be lined up against a wall and shot, reality tells me that somewhere along the line someone has to step to the plate and tell all they know under penalty of perjury. This ploy has been used by prosecutors forever. Give the main witness immunity if he tells the absolute truth. Pump sunlight to him forever if he doesn't. Cases in point. The Velochi papers and Sammy Grevano.

To immune one person to get the rest of the bunch is a small but ugly price to pay for justice.

7. immunity contigent on conviction of his superiors
If his testimony turns out to be, I did it, no one else knew, I don't recall - immunity gets pulled.

13. No immunity. People have to learn that cooperation with a fascist government
will always, in every case results in punishment. If he cooperates, reduce the sentence, but never immunity.
