BREAKING NEWS: Friend of mall shooter arrested

A 17-year-old Bellevue boy was arrested after being accused of threatening a girl whom he said made comments relating to Wednesday's fatal shootings at Von Maur.

David S. Horvath, of 3016 JoAnn Ave. in Bellevue, was taken into custody Thursday afternoon and brought to the Sarpy County Juvenile Justice Center.

Bellevue Police Chief John Stacey said officers went to Horvath's house Thursday to investigate a girl's report that Horvath threatened her for making disparaging remarks about his close friend, Robert Hawkins. Officials say Hawkins shot and killed eight people at Von Maur at the Westroads Mall on Wednesday afternoon before killing himself.

Stacey said officers arrested Horvath on suspicion of making felony terroristic threats. The officers also confiscated two shotguns and a rifle from the house, he said.

Horvath is a senior attending Papillion-La Vista South High School. Police continue to investigate the case.

On Thursday afternoon, Bellevue, Neb., police arrested one of Hawkins' teenage friends. David Horvath, 17, was handcuffed and taken into custody on suspicion of making text threats against another student. Authorities said guns were also taken from Horvath's home.

Bellevue Police Chief John Stacey said Horvath is charged with making terroristic threats.

Stacey said Horvath was upset that the student he threatened had said bad things about Hawkins.

Stacey said he doesn't have evidence that Horvath was part of the Von Maur shooting.

9. Actually, Minnesota has had laws on the books about "terroristic threats"

since long before 9/11. They originally had to do with stalking and domestic abuse cases, not terrorists in the sense Bushco uses the word.

The one I'm thinking of had BOTH parents killed in an auto accident. An uninsured driver crossed the median on interstate 80 and hit them head on. That stretch of 80 now has a jersey curb to prevent that from happening.

11. Wrong Horvath

Horvath was ordered today to undergo a psychological evaluation to determine whether he is a threat to himself or others. Sarpy County Juvenile Court Judge Robert O'Neal ordered him to remain in juvenile detention until the evaluation is done.

Horvath's parents, David Sr. and Sherry Horvath, will pay for the evaluation. A follow-up hearing is scheduled for next week.

8. Emotions are running understandably high

I surely hope that young Horvath gets some help, but with the authorities throwing around words like "terroristic" (whatever in fuck that means) to describe a text message by a 17-year-old, I'd say the chances of that happening aren't good. But we're flushing lives down the toilet wholesale in Iraq, so another guy on the cusp of adulthood in Omaha probably doesn't matter much.

Section 28-311.01
Terroristic threats; penalty.

(1) A person commits terroristic threats if he or she threatens to commit any crime of violence:

(a) With the intent to terrorize another;

(b) With the intent of causing the evacuation of a building, place of assembly, or facility of public transportation; or

(c) In reckless disregard of the risk of causing such terror or evacuation.

(2) Terroristic threats is a Class IV felony.

Annotations:

Subsection (1) of this section is not unconstitutionally vague. State v. Schmailzl, 243 Neb. 734, 502 N.W.2d 463 (1993).

As used in subsection (1)(c) of this section, the phrase "reckless disregard of the risk of causing such terror or evacuation" is not unconstitutionally vague. State v. Mayo, 237 Neb. 128, 464 N.W.2d 798 (1991).

Subsection (1)(c) of this section defines the crime with sufficient definiteness and ascertainable standards of guilt to inform those subject to it as to what conduct will result in punishment, and it is constitutional. State v. Bourke, 237 Neb. 121, 464 N.W.2d 805 (1991).

To violate the statute prohibiting the commission of terroristic threats does not require an intent to execute the threats made or that the recipient of the threat be terrorized. State v. Saltzman, 235 Neb. 964, 458 N.W.2d 239 (1990).
