White House directed to preserve backup tapes containing millions of e-mails
Source: AP

WASHINGTON (AP) - A federal judge is ordering the White House to preserve copies of all e-mails, a move that Bush administration lawyers have argued strongly against.

The order directs the Executive Office of the President to safeguard the material in response to two lawsuits seeking to determine whether the White House has destroyed e-mails in violation of federal law.

Two organizations allege the disappearance of 5 million White House e-mails, but the White House is seeking dismissal of the suits.

The Federal Records Act details strict standards prohibiting destruction of government documents, including electronic messages, unless first approved by the archivist of the United States.

3. Gov. Perry in Texas is having some email trouble, too.
They've been automatically destroying everything after 7 days unless there was a request. Interesting that he claims he is just continuing the policy that was put in place by Gov. Bush.

Gov. Blunt has been accused of purging emails in the Governor's office, too...I tried to get a link to the article in the St. Louis Post Dispatch, but I can't find it.

I guess this is a new page from the Republican playbook - purge your emails so they can't get caught.

U.S. District Judge Henry H. Kennedy Jr. issued a temporary restraining order today against the White House, ordering its executive office to preserve all records and back-up copies of millions of missing e-mails.

“Defendants shall preserve media, no matter how described, presently in their possession or under their custody or control, that were created with the intention of preserving data in the event of its inadvertent destruction,” wrote Kennedy in a Nov. 12 opinion in the U.S. District Court for the District of Columbia. The order was sought by the National Security Archive, a public interest library at George Washington University, and the Washington-based watchdog group Citizens for Responsibility and Ethics in Washington.

The groups alleged in separate, but now combined, complaints, that the preservation of more than 5 million missing e-mails is vital to the preservation of history as they reveal the inner thinking of President Bush’s top aides between 2002 and 2007.

“The judge’s order shows that the loss of the e-mail records is a serious problem,” said Meredith Fuchs, general counsel at the archive.

25. It's funny, earlier today outside my office window I saw a Cintas truck..
labeled, "Mobile Shredding Unit".

I commented to my coworker that that truck should probably be parked outside the WH instead. I read this story about an hour after the truck left. :)

44. Data is not destroyed
by shredders or physical means. The AES256 key that was used to encrypt the data on its way to tape or on disk is simply erased.

Once the key is gone, the data will never be retrieved in public.

My Fav excuse .... Holmes County ... well the coffee maker fell over and broke
into the box thar had the ballots and they got all wet and their was broken glass
so we had to thrown 'em out. (I would have thought you could have dried them
out and swept away the glass).

56 of the 88 Counties went ahead and destroyed them anyway.

To think that bush & company are going to comply with a judge's
order is a real stretch.

As Commander-in-Chief, why haven't you addressed the problem computers at the DoD?

43. No, not really.
I would assume they are using a pki system to protect files on spinning disk and on tape. This would be using an algorithm that will not be publicly reversed by any agency that could (aes256 for example)

When I travel I am sure the machine is using a cryptographically protected HD.

My point, unless you have the keys uses to write out the cyphertext you will not recover any usable data from backup media or a disk.

Destroying keys is the current way to comply with regulatory or security concerns.

The Bushistas have had 6+ years to scrub the national archives of both Baby Bush and daddy bush's crimes. Our best hope is that an insider grows a conscience and "Deep throats" the admin. I doubt the new Atty Gen will do anything. The Senate testimony proves he's another toady.
