Kerik Indictment Expected by Friday

A federal indictment against former police commissioner Bernard Kerik is expected as early as this Friday. Government sources say that if the indictment is unsealed on Friday, Kerik is expected to surrender at the Westchester Federal Courthouse in White Plains, N.Y...The sources say Kerik has told his close friends and members of his legal team that he expects the potential indictment to come before the statute of limitations expires on Nov. 15 on charges that could include tax evasion and bribery.

If the indictment is leveled against Kerik, it will be the latest twist in the tale that began when the child of a prostitute rose to police commissioner of New York City, achieved heroic proportions in the shadow of the collapsing World Trade Center, was gifted a diamond-encrusted chief's badge, awarded millions of dollars in stun gun stock options by business clients and given the proffer of a presidential appointment by President George Bush to head the Department of Homeland Security.

They will very likely include a struggle to pay legal bills that could result in the sale of his multi-million-dollar New Jersey mansion, a long stretch in federal prison and severe damage to his consulting practice, which includes lucrative contracts with U.S. ally Jordan, according to multiple sources involved in the investigation.

Last spring Kerik turned down a plea bargain in which the government offered a short prison sentence. Now friends of Kerik are attempting to raise money from his well-heeled associates for a legal defense fund, the sources said. It has been difficult, given that many of those associates may also have relationships with presidential candidate Rudolph Giuliani who is routinely questioned about his relationship with Kerik.

Rudy's relationships re-define social convention ... as I passed the still sadly named jail in downtown Manhattan w/my deputy director supervisor from Sanitation, he visibly blanched in shame.

2. You can bet that Kerik is in belief that Giuliani is pulling strings
for him. I believe that Kerik and Giuliani have more than a few dark secrets stached.



Kerik's mouth piece? Marc Mukaseyis the son of former federal Judge Michael Mukasey, a longtime Giuliani friend nominated by President Bush to become the next U.S. attorney general.

U.S. Will Ask a Grand Jury to Indict Kerik

Federal prosecutors will ask a grand jury today to indict Bernard B. Kerik, the former New York police commissioner, on charges that include tax fraud, corruption and conspiracy counts, according to people who have been briefed on the case.


The grand jury, convening in Westchester County, has heard evidence about Mr. Kerik for about a year as part of a broad federal inquiry into a variety of issues, including his acceptance of $165,000 in renovations from a contractor who was seeking a city license.

Prosecutors are also seeking to charge Mr. Kerik, 52, with failing to report as income more than $200,000 in rent that they say was paid on his behalf to use a luxury Upper East Side apartment where he lived with his family around the time he left his city post, the people briefed on the case said.

Investigators have not suggested that Mr. Kerik’s benefactor, Steve Witkoff, a commercial real estate developer, was involved in any wrongdoing. If the grand jury approves an indictment, as expected, it will remain sealed until tomorrow, when Mr. Kerik would be arraigned in United States District Court in White Plains, N.Y.

"I'm grateful he's agreed to bring his lifetime of security experience and skill to one of the most important positions in the federal government."
