Supreme Court Blocks Lethal Injection Execution: Justices may want to halt executions nationwide

WASHINGTON, Oct. 30 — The life of a Mississippi inmate who killed a woman after she left church choir practice 20 years ago was spared this evening by the Supreme Court, signaling that the justices may want to halt executions nationwide pending a challenge to the constitutionality of lethal injection.

Earl W. Berry, 48, was to have been executed in the state penitentiary in the Mississippi Delta town of Parchman. But his lawyers, having exhausted their state-court and lower federal court appeals, won an 11th-hour stay from the high court.

Barely a quarter-hour before Mr. Berry was to die, the Supreme Court granted a stay. The vote was 7 to 2, with Justices Antonin Scalia and Samuel A. Alito Jr. dissenting.

When the United States Court of Appeals for the Fifth Circuit dismissed Mr. Berry’s challenge on Friday, agreeing with states courts that he did not file his challenge to the injection method soon enough, eyes turned to the Supreme Court. The big question was whether the justices would delay the Mississippi execution, and demand a halt to others across the country, until the issue of lethal injection was decided....

Clarence didn't vote with Scalia? And that crap about didn't file appeal soon enough. Just using bureaucratic rules as an excuse. I'm anti-death penalty, in any case.

3. Ah, Antonin Scalia. He never met a prisoner he didn't want to kill!
Are they going to stop the upcoming execution here in Georgia? Or did that one already happen?

Scalia is a Bushie Mafiosi with robes. A criminal of the highest order and someone who would have served Hitler and Mussolini very well and with all his herat and soul.

As he serves the Bushies, who once served Hitler as HIS money launderers.

Just wondering if thats rhetoric or a fact because to be honest its the first I have ever heard someone claim it so I am wondering is all, mind you it would not surprise me but still a link showing the link would be interesting to read.

13. Wow, interesting family history there.
We can't blame the current Bush for that however when you compare his actions with things like Gitmo and spying on his own people now in the US it sends a shiver down my back because its similar to what went on in Nazi Germany.
Makes me wonder though how much Bush Sr knew and when considering he was in WWII, no evidence of course still..........
Anyway thanks for the links, if true it makes for some very interesting background on the Bush family.
