Statements Rep. Allen said following arrest are thrown out

"Comments state Rep. Bob Allen made to police after he was arrested and charged with soliciting prostitution will not be used in court, attorneys agreed Monday.

Attorney Greg Eisenmenger said his client Allen was not informed of his Miranda rights to remain silent until he was booked into the jail, after which police asked no more questions.

State prosecutors did not oppose Eisenmenger's motion to suppress Allen's statements and said the comments were not needed to prosecute the case.

Authorities say the Republican lawmaker from Merritt Island agreed to pay an undercover officer $20 to perform oral sex on him at a park restroom July 11. Police records say Allen told police he talked to the other man only because he was intimidated by the "stocky black guy" - who turned out to be a police officer."

Any dumbass who's ever seen five minutes of any cop show knows that. Again, WTF?


That said, you'd think that a professional legislator could be assumed to be aware of his civil rights, since they're something he's nominally supposed to be upholding...

Hard to interrupt someone who's being so comical, you know? I hope the prosecution is right, and they don't need Allen's stupid remarks to secure a conviction. The testimony of the arresting officer should be sufficient.

Curious, though, just how interested Republicans are in due process when it's their name on the docket instead of some nameless, faceless Afghani or Iraqi who may have simply been in the wrong place at the wrong time when the troops swept through.

...the police officer's testimony is probably all the prosecution needs.

I predict he'll enter a Pre-Trial Intervention Program (if he's eligible) and avoid the embarrassment of going to court.

13. Allen's statements after he were read his rights are damning
Allen's defense is weak and no jury is going to believe him about being scared.

And there's the racism issue that will be in the jury's mind when he tries to explain his actions.

tends to suggest that the evidence was "thrown out" of court by a judge. However, it is the prosecutors who are deciding not to even use the evidence.
