Las Vegas Sun Newspaper (AP)WASHINGTON (AP) - Newly released e-mails show a top Justice Department official expressed qualms about ousting Daniel Bogden, the federal prosecutor in Nevada, before a group of U.S. attorneys were fired and a Capitol Hill scandal erupted.
"I'm a little skittish about Bogden. He has been with DOJ since 1990 and, at age 50, has never had a job outside of government," Deputy Attorney General Paul McNulty wrote Dec. 7, the day Bogden and seven others were fired. "My guess is that he was hoping to ride this out well into '09 or beyond.
"I'll admit (I) have not looked at his district's performance. Sorry to be raising this again/now; it was just on my mind last night and this morning."
The e-mail was to Kyle Sampson, then chief of staff to Attorney General Alberto Gonzales. It's not clear how or whether Sampson responded, and a DOJ spokesman did not immediately return a call for comment. Sampson resigned March 12.

Ensign has complained that McNulty either lied to him about the reasons for Bogden's dismissal or was operating on faulty information. The senator says McNulty gave him shifting explanations about why Bogden was ousted, finally asserting that Bogden wasn't aggressive enough in prosecuting terrorism and obscenity cases. Then Ensign discovered that Bogden never had been informed of those concerns.
