they were sorry for Libby because it was apparent that the higher ups put him up to it. The columnist, Sidney Shanberg (NY Observer) wrote from the trial that the Libby trial was really was the subtext for an impeachment of Cheney.

WASHINGTON (CNN) -- Former White House aide I. Lewis "Scooter" Libby has been
found guilty on four of five counts in his perjury and obstruction of justice trial.

Libby, 56, faces a maximum sentence of 25 years in prison and a fine of $1 million.

The five-count indictment against the former aide to Vice President Dick Cheney
alleges perjury, obstruction of justice and making false statements to the FBI and a
grand jury investigating how Valerie Plame was outed as a CIA operative.

President Bush promised several times on television that whoever leaked this information to the press would be fired.

Since we now know that Bush and Cheney and Libby and other high ranking officials were the leakers, shouldn't the entire administration be impeached?

If this interferance with an investigation can land a man in jail, certainly lying to the country about the false evidence used to take us into war is an impeachable offence.

Justice won't be served until the man who told Libby to leak and lie is impeached.

Libby, the former chief of staff to Vice President Dick Cheney, was accused of lying and obstructing the investigation into the 2003 leak of CIA operative Valerie Plame's identity to reporters.

He was acquitted of one count of lying to the FBI.

But then, he'd probably wind up needing a pardon at some point, hmmmmmm? Because if he's no longer a sitting VP, does he still get that level of "protection"? Because he would be CITIZEN cheney at that point. NOT some exalted uber-executive. Does it make him less of a presumed "untouchable"?

And if scooter does get pardoned - I read comments here such that a pardon would remove all 5th amendment protections from libby, so he'd HAVE to sing like Pavaroti if hauled in before a Patrick Fitzgerald type again. Is that true? The speculation was about that being a reason why it would not pay for bush to pardon him. I'm not a legal eagle. Anybody know?

I'm not trying to rain on this parade, but as several other DU'ers have already mentioned, a presidential pardon of Libby by Bush is an almost certainty if attorney Wells' legal maneuvers would somehow fail (Wells just stated on CNN that he has already formally requested a new trial and if the new trial is denied, then an appeal will be made).

Additionally, all Wells and his staff has to do is to delay finalization of this process via legal maneuvers until after the November 2008 election -- all the while Libby remains free -- and then Bush can slam the door on justice with his presidential pardon. What a friggin' joke.

Bush doesn't give a flying frig about what our nation's citizens think of him. He sees himself as totally above the law and moral and ethical standards simply don't apply to him. Libby and any other future Bush administration personnel who are also found guilty prior to Bush leaving office WILL be pardoned by Bush prior to his leaving the presidency.

And for that reason, I don't foresee Libby or any other future Bush administration personnel ever cooperating with the prosecution. I also foresee Libby and any other future convicted Bush administration personnel never serving any prison time. -- Michael

libby and his lawyers will keep the case in the courts with appeals, etc. until Jan. 2009 when bush will issue the pardon.

86. If he's pardoned, can he still plead the 5th?
I mean, don't get me wrong, I think he should rot in jail, but, if he were pardoned, wouldn't Fitz (or Congress, assuming they have the mettle) be able to subpoena him to testify against the Big Dick? And with so much evidence in the record, it would be hard for him to lie. Since he couldn't place himself in legal jeopardy, wouldn't he *have* to testify???

If so, I'm sure Dick and Shrub will let him rot. Their fanatic loyalty is one-way only.

But he would be fully indictable on any NEW lies that he told on the stand of a Chenney trial. Can you plea the fifth if you can no longer be charged about the crime?

Immunizing testimony is done before the trial begins. It's done if the prosecutor knows you're a scumbag, but you carry information that can help lock up worse/higher-level scum than yourself. The tradeoff is that you must then be completely honest with the prosecution--but OTOH, if you can't get in trouble for your testimony, there's no real reason to lie.

This is why Bush, for instance, would never receive immunity: there's no such thing as a bigger fish than Bush, and any prosecutor worthy of the name knows Bush is genetically incapable of telling the truth. If Bush tells you the sky is blue, go outside and look up because knowing him, it's probably green.

Pardons do one of two things: either stop prosecution of a person, or overturn any guilty verdicts that may have been entered against him. As far as I know, they don't protect someone from having to testify against someone else.

in the system whatsoever and I sold Fitzgerald short, I didn't think he'd be able to get a conviction.

I would like to say that a lot of my doubts were because of the makeup of the jury. I need to have more faith in my fellow Americans maybe? But after the past eight years it's damn hard.

If he gets a pardon I won't be too upset. That won't erase his conviction.

The fix is in though.

He'll stall the sentencing. Then he'll appeal for a new trial. Then he'll appeal the decision.

And then, in January of 2009, Nixon (ooops, sorry, bush) will pardon him along with a bunch of others.

And he'll make BIG BUCKS at some corporation and with his book deal.

And next repuke administration, he'll be there just as rummy, cheney, powell, negroponte and the rest of the ray-gun/bush criminals were.

Or maybe he'll get a talk show like that fuck oliver north...

and the questions in the media as to whether Cheney will be stepping down.

I predict that if there is an indictment, Cheney will go. That being said, I think the fact that the jury has been out so long together with their questions re: reasonable doubt are troubling and may suggest an acquittal. I hope that I am wrong.

154. Given some of the questions the jury has been asking, I'm expecting to be disappointed.
There's a story on MSNBC claiming the jury was asking for clarification of whether Libby was accused of lying to the FBI about what he told Matt Cooper, or of lying to Matt Cooper, or of not knowing that Plame was a CIA agent when he claimed she was. Doesn't give me a lot of hope about their level of competence. Hopefully they were only trying to convince one juror of what everyone else understood, but still worries me.

Hopefully my expectations of disappointment will be disappointed. :)

In my mind, it is more likely those holdouts were for innocent rather than guilty. Sounds like the holdouts were convinced. If it were the opposite, I don't believe a couple of people would hang out for guilty when everybody else said innocent.

169. This is AWFULLY quick following that note, in the grand scheme of things
Speculation was that there was a 'reasonable doubt' holdout, unsure of the definition.

Then some thought the jury was hung, but there was no Allen charge.

It could well be that the doubtful juror/jurors had their concerns assuaged so they were able to render a decision.

Heh. The judge didn't tell the jury because it was immaterial to the charges against Libby, so I'm not sure exactly what that freeper feels Scooter's grounds for appeal are.

In any case, I just heard Fitz say unequivocally that Plame was definitely a covert operative. The way he stated it left no room for doubt.

OT a little bit, I'm currently watching Scooter's lawyer on MSNBC - is it just me, or does he seem all over the place speaking? Fitz's press conference was concise and to the point, but this guy just seems to be rambling. Like I said, maybe it's just me.

Whoever, in the course of a pattern of activities intended to identify and expose covert agents and with reason to believe that such activities would impair or impede the foreign intelligence activities of the United States, discloses any information that identifies an individual as a covert agent to any individual not authorized to receive classified information, knowing that the information disclosed so identifies such individual and that the United States is taking affirmative measures to conceal such individual's classified intelligence relationship to the United States, shall be fined not more than $15,000 or imprisoned not more than three years, or both.

remember that Fitzgerald's entire premise for this prosecution was that Libby's lies made it impossible to learn the truth about what really happened.

Cheney's plan worked perfectly.

Libby's lies blocked Fitzgerald from prosecuting for the leak. Fitz said as much before the trial. He has also said the investigation is now over.

In the end, treasonous criminals still squat in our White House, and their pigeon will be pardoned to write a book about his "persecution". The subsequent talk show, book tour, and speaking circuit will make it a bestseller and I. Lewis will more than recoup his legal fees and fine.

as it is, her very narrowly defined statement, glosses over that while the conviction
was only over lying and obstruction of justice, the larger issue is that the white
house and many of its leaders (rove, cheney, Bush, etc.) were part of treasonous
activities to out a CIA agent during a critical runup to a potential war.

if the CIA is not more than a little vindicated by this, they should be.

CONGRESS Is collectively covering their ass right now and too afraid to say the
really honest things like the juror said, "What about rove, etc.?"

it took an american citizen to say what the fuck the politician asswipes and
media whores could not say.

it sickens me that people are happy with what is now a deadend/inactive investigation
that will certainly result in libby doing not a single day in jail with appeals and other
court maneuvres buying him time till bush pardons him.
