In April, prosecutors lined up 45 relatives of Sept. 11 victims to testify in support of Moussaoui's execution, and the government was hailed for giving the families a voice in court.
Behind the scenes, however, they argued in closed hearings that U.S. District Judge Leonie Brinkema should not allow other 9/11 families to testify for the defense.
"The defense wants these witnesses only to sneak in something about their anti-death penalty views
the court should not allow it," prosecutors wrote in an April 3 pleading unsealed this week.
Brinkema ruled in favor of the family witnesses that defense lawyers recruited. Most spoke about forgiveness and reconciliation, implying that Moussaoui's death would serve no purpose.
