BREAKING: LAWSUIT IN CA TO HALT USE, PURCHASE OF DIEBOLD VOTING SYSTEMS!

BREAKING: LEGAL ACTION TO BE FILED IN CALIFORNIA TO 'HALT USE OR PURCHASE OF DIEBOLD VOTING MACHINES' IN STATE!
Lawsuit to Name Sec. of State Bruce McPherson, Alleges 'Severe Security Risk', Noncompliance with HAVA's Disabled-Voting Provisions, and Violation of CA State Law!


The BRAD BLOG can now reveal that a legal action will be filed tomorrow morning in California's Superior State Court in San Francisco in response to Secretary of State Bruce McPherson's recent re-certification -- in blatant violation of state law -- of Diebold's Electronic Voting Machines in the state.

VoterAction.org is announcing their intention to file their suit on behalf of several plaintiffs, "aimed at halting the use or purchase of Diebold electronic voting systems" in the state.

According to VoterAction, the legal action is being filed because "Diebold's TSx touch screen voting system is a severe security risk, and does not accommodate all disabled voters as required by law."

They also add that that "The Diebold system is difficult if not impossible to audit or recount, and has been proven vulnerable to malicious tampering in tests and studies. Diebold technology contains 'interpreted' code, which is easily hacked, and illegal for voting systems in the State of California."

The same group recently carried out a similar action in the state of New Mexico, in regard to the use of Sequoia Touch-Screen voting machines there. That suit ultimately led to the ban of use of such machines, and a bill which was recently signed by Gov. Bill Richardson requiring a paper ballot with every vote cast in the state...

I hope so! I don't want our special election to replace the Dukestir to get f'd up with these machines! Getting an injunction for this election would be music to my ears!

Perhaps the timing of this election can force an early injunction on them too! Someone remind the judge he needs to act quickly to provide an alternate set of voting mechanisms here in San Diego. It might be too late already. I already got my voter pamphlet in the mail last week. Hope not!

27. Prior to moving to Oregon
I voted via absentee ballot in two other states. About 3-4 years, I posted on the largest online board for the disabled, asking how each voted.

The overwhelming majority did as I did - voted absentee ballot. This crap about "the DREs are needed for the disabled" is just that, crap!

Btw, I am disabled.

26. Hey SFexpat2000! I just realized this is Voteraction.org! I met Lowell
Finley and Holly Jacobsen last year at a fundraiser hosted by Peter Coyote! They are a great group and I'm so excited they are doing this! I just called Holly and confirmed that yes, they are doing the press conference tommorrow at the law firm in Downtown SF that is working on this case with them.

They are a good group of people....I donated to them and am going to support them on this all the way!

34. FABULOUS! I went straight to their site and signed up!
They have an e-mail link so I wrote and asked if they have any hand-out materials I can use locally for voter education -- and most especially, do they have something I can use to educate the County Registrar and Board of Supervisors.

I really need something that explains the issue succinctly -- so I don't come off sounding like I've misplaced my tinfoil hat. I hope they can help.

In addition they even have a land address for donations, for us Luddites who don't use PayPal. Love it.

Those of us in the cumputer biz have been screaming bloody murder about these devices for yrs. finally the counter attack is beginning!! The simple truth is our voting systems should be in "private" hands voting is a PUBLIC trust and turning this over to partisan Corps. like Diebold or Sequioa has been insane from day 1. The irony of the 2000 Fla. debacle is that the forces of evil (Bu$hCo et al.) used that disaster to force the states onto these devices! Nobody at the time realized just how bad a move that was everybody still harbored this illusion that computers somehow meant progress. Unfortunately, just such thinking still exists among the ranks of many Demo. pols for some unknow reason? Computers and voting don't MIX. Paper ballots at some pt. in the process is absolutely necessary. New Mexico's new law is a good start but I'd like to see all computers taken out of the voting at all levels. Paper is used in most of the world's democracys for good reasons. If allow the rethugs to shove auditless voting systems down our throats we can permanently say good-bye to our democracy atleast on the Nat'l level. If we need to fight these kinds of battles state to state to stop the hard right from stealing our country so be it let's get to work. The simple fact is we are at war with these people and they intend to win with these devices if we don't stop them. As for the BIG DC DEMOS forget about them we're going to have to win this one on our own.

73. Awesome news out of Cali!
Also folks,as I'm sure many of you already know, my home state of Maryland has recently decided they don't want any part of the diebold machines either! Our hard work is finally starting to pay off! Keep up the good work people. We've still got a long way to go.
