AP: Time Reporter Interviewed in CIA Case

Special counsel Patrick Fitzgerald spent more than an hour Thursday morning at a law firm representing Viveca Novak, a Time magazine reporter whose testimony was being sought in the CIA leak case.

Fitzgerald and an associate emerged from the office of attorney Hank Schuelke at 11:30 a.m. EDT, declined to answer questions and rode away in a taxi cab. A short time later, a court stenographer left the building.

An hour later, Schuelke escorted Novak from the building and helped her flag a taxi. He declined comment when asked if she had provided sworn testimony in Fitzgerald's investigation of the leak of an undercover CIA agent's identity.

I found it outrageous that she is covering this case when she is extremely close with a lawyer who's representing a high-profile client. Hopefully, Fitz didn't buy what she said to help the Rover.

maybe she is a Democrat also and will not go out of her way to help Rove.

15. I'm worried they coordinated their testimonies
to help the Rover. According to firedoglake (which beat the NYT in reporting that Novak told Luskin), Viveca tried like hell to avoid testifying under oath. It looks to me as if she didn't want to face any repercussions while helping her good friend Luskin do what he gets paid to do.

why is her testimony being taken from the refuge of her attorney's turf?

She and her attorney are doing their best to get Rove off the hook - if Fitz is buying what they are selling, we might as well forget anything more coming out of this investigation

she is being given special privilege it seems to me

As ReddHedd (a prosecutor) notes, Ms Novak may be cooperating and Mr Fitzgerald is respectful of the GJ's time. And, Mr Fitzgerald might want to get her sworn testimony before bringing it to the GJ.

Mr. Fitzgerald spent three hours with a new GJ yesterday. This is far from over.

Fitzgerald is no idiot. If Luskin and Ms. Novak are conspiring to protect Rove, I guarantee you that the special prosecutor sees right through it. He's got his ducks in a row and is just being careful about how and in what order he shoots them down.

As for the "special privilege," I imagine he is coddling her so as to avoid giving the media an opportunity to try to paint him once again as an overzealous prosecutor trampling all over the first amendment.

6. Hot Diggitty...
I found a very cooperative witness in one Viveca Novak this morning. My cases are all coming together now. After wolfing down my pastrami on rye and chugging a Yoohoo courtesy of her lawyer Hank Schuelke I grabbed a cab back to my office and the mission at hand - fighting for truth, justice and the American way.

On a side note, feeling a bit sheepish here, but can anyone recommend how best to remove a mustard stain from my new wool suit slacks?

13. Skinner...a wonderful amazing feature for DU...but I can't use
the "Research" Forum. I followed you instructions but I just am "clueless" even doing the "Practice Thread."

I wish you well though. There are so many new "tech savy" DU'ers that I'm sure it will go well. I wish I could have posted my "How Abramoff was involved in 2000, 2000 and 20004 Elections Thread in the new Forum..I couldn't figure it out.

But...what the hell...I should just go back to my Sewing Machine and forget this stuff ...it's too tech for me...so that means "I'm Out."

I would bet my house on it.. I've been researching this for over a year (and as many know created a 2 DVD set film called "Rove's War", the complete and definitive Chronology of PlameGate at http://www.takebackthemedia.com) and let me tell you HOW I think it will happen..

Or at least one very important fact.

Rove LIED to the FBI From the START. Remember Mr Hubris, the Godlike Pigman THOUGHT he was impervious to Crime - they had "Beat by a Dead guy" Ashcroft ON IT, until someone realised that "ooops.. Rove took more than a million bucks from Crisco Boy so Ashcroft had to recuse himself..

DURING that period Rove was Interviewed by the FBI.. now remember, he's been using the FBI as his personal attack unit as far back as his early days in Texas (this is all in the film, btw) when he was bringing down the Dept of Agriculture, guys like Jim Hightower escaped with minor abrasions, but many others had their complete lives DESTROYED by Rove there..

SO he and the FBI are old buddie.. so one can imagine that he'd just lay a bunch of bullshit on them and tell them to get out of his office, and pick up a stack of hundreds on the way..

But the FBI as I understand it actually FILED REPORTS on what Rove SAID during that period.. Reports that Fitz NOW has in his hot little hands.

In my humble opinion, THOSE interviews coupled with the Cooper fiasco WILL give Fitz what he needs, and whatever else he's got in his Fitzmas Stocking on Rove, to TAKE ROVE DOWN..

I'm hoping before the new year, but as long as Fitz wants to take to make it airtight, so be it - he's got to make it SLIME TIGHT with these guys :)

So go to Takebackthemedia.com, watch the 12 minute preview and help us HELP Fitz and the Public by getting out the word and fighting the SPIN.

I'm getting goosebumps just thinking about it all :)

If anyone wants to post on Conyers Blog about the film available at Takebackthemedia.com I'd sure appreciate it (as a matter of fact it's sitting on his aide's DESK, he's been busy) so that HE can get it out to as many Congress folks as possible - we're offering it FREE to Congress people - I'd post but I just signed up and don't want that thread to fall there before I get my password.

THANKS to UnderstandingLife for his postings on this MOST important subject, I also sent off a copy of the film to firedoglake and am waiting to see what they think about it -

I can't imagine them going against Bush.
If so, why haven't they attacked them on multiple crimes and
misdemeanors like the CIA members and former members.

The only reason to this madness is that the FBI made the mistake of
recording these lies.

More hopeful when reading your post. I spend a lot of time at FireDogLake but am beginning to get antsy about Fitz and hope he is not another Kerry.

Why doesn't the prosecutor of AIPAC, Abramoff, Delay and now Cunningham get the same kind of press as Fitz? Seems like the work they are doing is pointing directly to the White House.

A special prosecutor questioned Time magazine reporter Viveca Novak under oath yesterday about a conversation she had with the attorney for presidential adviser Karl Rove that has become part of the CIA leak investigation, according to a top editor at the magazine.

In another twist, the lawyer, Robert D. Luskin, was deposed on the same issue last Friday, a source close to the case said.

According to sources familiar with Rove's status, Luskin persuaded Fitzgerald in late October to postpone indicting Rove by alerting Fitzgerald to Luskin's previous conversation with Novak, among other things. Luskin argued that these private discussions helped show Rove did not intentionally conceal his conversation with Cooper from investigators. Rove has argued he forgot about the chat he had with Cooper on the phone in the summer of 2003.

Sources familiar with their conversations say Novak's and Luskin's accounts to Fitzgerald appear to conflict on when they spoke.

Time's managing editor, Jim Kelly, said yesterday that the magazine will publish Novak's account of her testimony in its Monday edition, and it will be available in an online edition Sunday. Kelly said he did not yet know and could not comment on the full details of Novak's testimony or Fitzgerald's questions because he had not spoken with the reporter.

21. Here is the all important part:
A source familiar with Novak's account said she believes the conversation took place in March or May, and definitely took place after February 2004, when Rove first testified before the grand jury.

But one person close to the case said the conversation took place before Rove's first grand jury appearance in February. This person said the conversation was not the event that led Rove to change his testimony.

And he inadvertently gave false and misleading testimony in February that his counsel accidentally discovered in March or May, why didn't he correct the testimony when it came to light instead of waiting until the day before indictments?

Suppose he forgot that, too. GOP Alzheimer's. Next we're going to hear WW III has started because George forgot he had his finger on the button.
