New DeLay Case Judge May Face Challenge
New Judge Appointed in DeLay Case, but Prosecutor Questions the Validity of the Appointment

The Associated Press

AUSTIN, Texas Nov 4, 2005 — A new judge has been appointed to preside over Rep. Tom DeLay's campaign finance trial after two judges stepped away from their involvement in the case because of their own political contributions.

But judicial wrangling left the validity of Thursday's appointment of semiretired Senior Judge Pat Priest of San Antonio in question.

Priest, a Democrat, was selected to replace District Judge Bob Perkins, who was removed Tuesday at DeLay's request because of his contributions to Democrats.

Republican Administrative Judge B.B. Schraub had been named earlier Thursday to select a new presiding judge after Perkins was removed, but he withdrew at the request of Travis County District Attorney Ronnie Earle because of his political contributions to GOP candidates.

he looks like a fool because he is a fool. He is also corrupt, arrogant, and a perfect example of why neocons have ruined our country. He, Bush, Cheney, the whole gang of cronies need to go.

13. Oh no no no no firing squad. We are talking lots of trash pick up
and lots of road work. People from near and far will be able to come and watch Convict #_______ repay his debt to society. School groups will be brought it to illustrate an example of the checks and balances of multiple layers of government.

6. How long can they "Delay" like this ? Sorry about the pun. And once they
settle on a judge, they will fight over a "venue". Is there also a jury to select in this type of trial?

I don't get it. If I go to court, can I select a judge based on his political leanings and contributions?

7. That subtitle is such bullshit, isn't it? Earle hasn't objected to new
judge Pat Priest, and they even say that in the body of the article. They are trying to slam Earle as in "no one will make him happy", and try to slip into innuendo instead of fact.

Never mind this whole brouhaha was started by DeGuerin.

What crap passes for "journalism" these days amazes me.

8. Seeing as the criteria for finding a judge is now predicated on
their political donations, connections, etc, if Priest has made no donations to political parties, received no donations from political parties, had no connection to any political action committees while running for office, he will meet the criteria.

Delay opened a can of worms that will not serve him well, imo.

11. Judges usually decide whether to recuse themselves, but here
they passed the decision to another judge. I agree with everyone - they will NEVER get a judge if they get to disqualify on the basis of party affiliation or contributions. Judges in Texas (and a lot of other states) run and are elected with political affiliations.

This whole thing is stupid.
