Scalia Ridicules Court's Gay Sex Ruling
WASHINGTON - Supreme Court Justice Antonin Scalia (news - web sites) ridiculed his court's recent ruling legalizing gay sex, telling an audience of conservative activists Thursday that the ruling ignores the Constitution in favor of a modern, liberal sensibility.

The ruling, Scalia said, "held to be a constitutional right what had been a criminal offense at the time of the founding and for nearly 200 years thereafter."

Scalia adopted a mocking tone to read from the court's June ruling that struck down state antisodomy laws in Texas and elsewhere.

Scalia wrote a bitter dissent in the gay sex case that was longer than the ruling itself.

1. Slavery was constitutional at the time of the founding
Does this mean that Scalia favors slavery? Scalia is a member of the radical ultra-rightwing Catholic cult of Opus Dei. We can expect no less from such a man. BTW, Clarence Thomas is also a member of Opus Dei.

I get a kick of these Bible-quoting moralists who seem to ignore some of the really hot stuff in the Bible about gays. The story in the Book of Samuel about the love between a young bisexual David, and the older homosexual Jonathan, King Saul's son, is one to raise (or pluck) quite a few eyebrows:

The Bible makes very few mentions of homosexuality - lesbianism isn't mentioned at all in the Old Testament - and as the examples below show, interpretations of the verses that do exist differ hugely.

Following each of the verses below is a brief illustration of what a hardline pro- and anti-gay position might be. (Most Christians hold views somewhere in between these two stances.)

An illustration of the division can be seen by what either side might say about the friendship in the Old Testament between David and Jonathan. I don't have the chapter-and-verse, but there are several things the Bible lists as "abomination".

One of them, of course, is translated in the modern world as "homosexuality".

Another one of them is clothing made from two different kinds of fabrics woven together. Like, for instance, linen and wool. Or cotton and polyester.

Funny how God Almighty has a fashion sensibility similar to modern gay men.

OTHER PEOPLES sex at that- a bizzare bunch indeed. I could really care less who puts what in their mouth or their anus- but folks like Scalia, Bush and Ashcroft cant seem to stop thinking about it...

...I find Republican's obsession with controlling other peoples sexual activities much more strange than folks actually HAVING consensual sex..

I mean, why are a group of "conservative" men sitting around thinking about gay men's sex lives- why do they even CARE??????

10. You strongly imply that Scalia is gay and then

ask "Wasn't he an altar boy?" Your suggestion that because Scalia is a Catholic male, he must have been an altar boy is within reason, but to go out on a limb hinting that he must have been abused by a pedophile priest is quite a reach. Then you make a huge leap of illogic as you seem to conclude that being abused is what made him a closeted gay (getting back to your initial unproven assertion.)

If sexual orientation is an inborn trait, as is usually argued today, Scalia's orientation, whatever it is, was inborn. Thus, the supposed abuse by a pedophile priest that you hypothesize should not have affected his orientation. It cannot logically be argued both that orientation is inborn and conversely that orientation can be changed by sexual abuse.

12. I took it more as a lampoon on the bizzare GOP/sex obsession...
...I dont think he is really suggesting that Scalia is gay...however, there is certainly some form of "repression" or deviance that makes Scalia and the like 10 times worse than those engaging in consensual sodomy ...

The point is that these guys are unaturally obsessed w/ other peoples sex lives, I imagine them all sitting around in "outrage" over "all those nasty things" those "gays" do...It's pretty pathetic/humorous to me that these clowns try to control other peoples genitals- perhaps they cannot control their own inadequate "dirty parts?"

Your posts reflect my thoughts exactly. I think that people who worry about other peoples' intimate activities and preferences are mentally ill.

Some people cannot establish and respect interpersonal "boundaries," and feel compelled to control the lives of other people. They are known as co-dependant, sociopaths, etc.

Such people are best avoided.

25. I have knowledge of a specific case...
A very handsome young attorney in D.C. was full-bore raped by his parish Catholic priest in Virginia as a young man. A few years ago he and his wife put a down payment on a house from the out-of-court settlement negotiated years before the the Boston scandals. Point being....anal rape did not "convert" the young man to homosexuality; he was already hardwired by genes to be attracted to females. His good looks made him prey. Today, gay guys still hit on him (even with his wedding ban) but he takes it strides, and in his free time concentrates on trying to make a baby with the wife.

let's return to those halcyon years of the 18th century. Slavery was legal, women knew their place, and hypoctitical white men ruled the earth. The only thing that hasn't changed is that hypocritical white men continue to rule the earth. Scalia and the rest of these dinosaurs need to realise that unlike them, society has evolved. I can't begin to explain the loathing I have for he and his ilk.

The irony is, that the right-wing have more to fear from him, than any liberal. What Scalia has done to police rights, in essence giving them almost complete discretion by allowing pretextual traffic stops, will turn the right-wing's blood cold when the police begin to apply those rules to suspect paramilitary groups.

Refuting 30 years of scientific theory that solely credits hormones for brain development, UCLA scientists have identified 54 genes that may explain the different organization of male and female brains. Published in the October edition of the journal Molecular Brain Research, the UCLA discovery suggests that sexual identity is hard-wired into the brain before birth and may offer physicians a tool for gender assignment of babies born with ambiguous genitalia.

“Our findings may help answer an important question — why do we feel male or female?” said Dr. Eric Vilain, assistant professor of human genetics and urology at the David Geffen School of Medicine at UCLA and a pediatrician at UCLA’s Mattel Children’s Hospital. “Sexual identity is rooted in every person’s biology before birth and springs from a variation in our individual genome.”

Since the 1970s, scientists have believed that estrogen and testosterone were wholly responsible for sexually organizing the brain. In other words, a fetal brain simply needed to produce more testosterone to become male. Recent evidence, however, indicates that hormones cannot explain everything about the sexual differences between male and female brains.

Vilain and his colleagues explored whether genetic influences could explain the variations between male and female brains. Using two genetic testing methods, they compared the production of genes in male and female brains in embryonic mice — long before the animals developed sex organs.

To their surprise, the researchers found 54 genes produced in different amounts in male and female mouse brains, prior to hormonal influence. Eighteen of the genes were produced at higher levels in the male brains; 36 were produced at higher levels in the female brains.

“We didn’t expect to find genetic differences between the sexes’ brains,” Vilain said. “But we discovered that the male and female brains differed in many measurable ways, including anatomy and function.”

Based on comments from two people I know who clerked for the Supreme Court, Scalia (and his habit of ridiculing the other justices in his dissents) is not exactly the most popular member of the Court, and I bet he's actually turned people off who otherwise might have voted for him.
