Replacement named for judge who died of apparent suicide
June 15, 2005 - 2:27 p.m.

EDINBURG, Texas — Gov. Rick Perry on Wednesday selected a municipal judge from Mission to fill the post of a state district judge who apparently committed suicide.-snip-

Pena, 48, becomes the only Republican state district judge in Hidalgo County. He has been a municipal judge for 19 years.

Aparicio was five months into his third term and had been the target of a federal corruption investigation at the time of his death.

1. Strange statement:
Authorities have said they believe he shot himself.

What kind of authorities do they have that can't determine if someone shot himself?

THE DEATH OF JUDGE EDWARD APARICIO

In Hidalgo County in the small town of Edinburg sits the county's seat of government and its courthouse. Long on political history the area sat relatively quiet until recently. On April 5, 2005 tragedy struck the good citizens of that county and the area known as the Rio Grande Valley with the news of the death of Judge Edward Aparicio.

Aparicio, who would have turned 47 on Monday, was born in Washington to migrant farm workers. He attended undergraduate school at Fresno State in California and was an avid sports enthusiast. He was recognized as distinguished alum. He attended the University of Houston law school and was first elected to the 92nd bench in 1996.

Shock was the initial reaction of most citizens who came to love and respect the recently deceased judge who had been dogged by an FBI investigation looking into courthouse activities.

It is now known that Judge Aparicio borrowed his court baliff's gun and visited a shooting range before his death.

Although a large segment of the population still hold onto suspicions that foul play was involved most of the authorities seem to indicate in news reports that the judge's death was a suicide.

The local paper, the Monitor, which participated in the story from the beginning with less than acceptable ethics seems to raise questions about others without looking at the blood on its and the hands of its writers. One of the questionable writers lost her job at the Monitor recently but is that enough? Surely not enough to blame everyone else while ignoring their own participation.

On Monday, the Hidalgo County Sheriff Lupe Treviño found the judge at his home, dead from an apparent gunshot wound to the head, with a pistol near the body. Just hours earlier, a consultant had faxed local media outlets an announcement that Aparicio was resigning from the bench.

"The demands of my position as your Judge have unfortunately taken a toll on my personal life," Aparicio’s statement read in part. "I am resigning from the bench to dedicate more time and energy to my family and to personal family matters that require immediate attention. … (S)tepping down from the bench is an important step to take at this time."

Did Aparicio’s death have anything to do with possible legal troubles? Putting aside the various rumors floating around Hidalgo County, we have to consider the pressure that the federal investigation must have put on Aparicio.

The FBI raided the judge’s home and office on Jan. 16, 2004. Agents spent more than six hours searching the premises and carted off boxes of documents, along with framed paintings and photographs. The U.S. attorney’s office stressed at the time that the raid was part of an ongoing investigation and no charges had been filed.

Aparicio later said the raid was politically motivated, and he went on to defeat a challenger in the 2004 Democratic Primary and win an uncontested general election last November.

Aparicio...was the 92nd district judge , and it appears, an around good guy.

PERRY TO APPOINT JUDGE'S REPLACEMENT - I SMELL A RAT!

Republicans, it seems are lining up to fill the spot of the late Judge Edward Aparicio, reports The Monitor newspaper.

At least one of the applicants may have applied a bit too early. Forgive me for pointing out the obvious, but the paper indicates that one candidate, applied one day before the raid on Aparicio's house.

"(The applicant's) application is dated Jan. 15, 2004, one day before federal agents raided Aparicio’s home and office."

I smell a rat! The writer of the article seems to imply without saying so what many of us are thinking down here in the Republic that Politics may have somehow been involved in the process.

Don't tell me that a person just wakes up in the morning and for no apparent reason applies for an appointment with the Texas governor to be judge, in a place held by a man who coincidently happens to have his house raided by the FBI on the next day.

Now maybe there is an innocent reason for this but somebody needs to start asking questions!

READER: What Texas judge doesn't accept bribes? That can't be the reason he's been ousted from the bench- on a permanent basis. The story that interests me is the judge's involvement in cooperating with a "runaway" grand jury that indicted the Texas Child Custody Service Dept. The prosecutor in the case was so scared of that prospect that he stated in court that he would ignore his own grand jury and not prosecute -even if it cost him re-election .They set up Judge Aparicio because he uncovered what some of the sickos at the Texas Child Custody Service Dept were doing with some of the children in their charge. Florida is embroiled in the same imbroglio. Some of the more cute kids are being delivered into the paws of top leaders in the United States to sate their their sick sexual appetites. Consequently, these leaders become blackmailed Ziopuppets . Human trafficking thrives in TX. Fl. and NY. This kind of operation is typical in fascist states.

DA drops indictment against CPS

EDINBURG — An Hidalgo County grand jury’s indictment of the Department of Family and Protective Services has been dropped.

Hidalgo County District Attorney Rene Guerra said Wednesday he had formally filed a motion to dismiss the charges that the grand jury brought against the agency, formerly known as Child Protective Services, in June for three felony counts of causing bodily injury to a child. The case was in Judge Ed Aparicio’s 92nd state District Court.

"I finalized the paperwork a couple days ago. The reasons are still the same: the indictment is inappropriate against a statewide agency," he said. "The problem with CPS should be addressed by the state legislature, the governor, speaker of the house and the lieutenant governor."

The grand jury’s indictment of the agency stemmed from the allegations that a stepfather sexually abused three sisters, now ages 12, 13 and 14.

The grand jury charged that the agency caused bodily harm to the sisters by failing to protect them from being sexually abused by their stepfather, Ricardo Cosme Torres, 30, and physically abused by their mother, Maria Ramona Torres, in December 2003. The couple also was indicted.
