Man Shot Instead of Tasered, Sues Rochester

When a Rochester police officer arrested a man more than two and a half years ago, he thought he fired his taser gun.

But he didn’t, he actually shot the man with a .40 caliber pistol.

Now, that man, a 34-year-old refugee from Sudan, is suing the city of Rochester and three of it's police officers for $2 million.

Note that the news here is the lawsuit, the incident that prompted it old. The attorney for the city is taking the position that since the officer didn't intend to use deadly force, the lawsuit should be dismissed...

1. The BCA never acted on it, finding him in error
not willful in his effort.

The burdon of proof is lessor in civil court so this should be interesting. I do know its made life hell for the other Rochester police and made relations somewhat strained between Police and the Sudanese community here. Fortunately, other relations are decent and this had been somewhat forgotten. Be waiting to see what happens.

If he had been tasered he probably would've died, given their track record.

Good lord, what, do they have too many weapons on their belts and they get confused? :shrug:

Tasers should be outlawed. It is that simple.

4. Yup, let's make sure the only "gun" on the officer's belt....
is the one that shoots "hot lead". Wheeee!!!

/waiting for the anti-Taser crowd to say that tasers are more lethal than handguns, and being shot with a handgun feels like "a bee sting".
