GOP dealt blow in (WA gov.) vote trial

WENATCHEE -- Republicans suffered a setback yesterday (Monday) to their late-developing strategy to claim fraud in the governor's race when a judge said the fraud claim can't stand as a key to the party's legal challenge of Democrat Christine Gregoire's 129-vote victory.

Chelan County Superior Court Judge John Bridges' statement on the fraud claim is critical. Under Washington law, defeated Republican candidate Dino Rossi most likely would need to establish fraud to get an election overturned, because simply showing the number of improper votes exceeded the margin of victory would not be enough.

Without fraud, Rossi faces the much more difficult task of proving that Gregoire owes her win to illegal and improper votes or actions.

... Bridges is hearing the case without a jury, but no matter what his verdict, it's nearly certain the losing side will appeal to the state Supreme Court.

Which I think is a fair trade.

Gore should have contested.

On my way to lunch, I walked past a bunch of Republicans protesting with elephant flags. They looked very, very angry. I gave them a wide berth.

14. I told someone on Washington tread, if you don't have solid proof of fraud
GOP cannot use it and Judge is not going to allow it and in this case, there were no fruad involved. Maybe mistake, but not fraud like GOP is screaming about. Fraud and Mistake, there's big difference.

The fight for judicial appointments is so important!

If the Repubs appeal this decision, where does in go? Would it end up being decided by Pryor, or Owens, or Rogers-Brown?

The American people seem to be waking up. After 9/11 and the build up to war, I got the impression that the voters were like one of the Bush twins at Spring Break. Drunk, stumbling around, having every orifice filled in an alcohol induced stupor. I think some have sobered up and now see the people they've been used by, and I don't think they like it.
