House to issue subpoenas to keep Schiavo alive (Terri asked to testify?)
Edited on Fri Mar-18-05 02:09 AM by truthpusher
The story below (from AP) says that a 'Subpoena/s' will be issued. The story did not say to whom they will be issued. However, Drudge Report had this to say:

"**Exclusive Fri Mar 18 2005 00:50:07 ET** The Chairman of the Health, Education, Labor, and Pension (HELP) Committee, Mike Enzi (R-Wyoming) has requested Terri Schiavo to testify before his congressional committee, the DRUDGE REPORT has learned. In so doing it triggers legal or statutory protections for the witness, among those protections is that nothing can be done to cause harm or death to this individual.

Members of Congress went to the U.S. Attorney in DC to ask for a temporary restraining order to be issued by a judge, which protects Terri Schiavo from having her life support, including her feeding and hydration tubes, removed... Developing..."

Of course, I will post more as it comes up. Here is the AP Story:

AP NewsBreak: House to issue subpoenas to keep Schiavo alive

JESSE J. HOLLAND
Associated Press
------------------------------
WASHINGTON - In a last-ditch effort to save Terri Schiavo's life, a House committee plans to issue subpoenas Friday to stop doctors from removing the severely brain-damaged woman's feeding tube.

The extraordinary legislative maneuver comes after the House and Senate failed to agree on legislation to keep the woman alive before leaving Washington for their spring break. House officials hope that the subpoenas will stop doctors from removing Schiavo's feeding tube at 1 p.m. EST Friday.

"We will issue a subpoena which will require hospice administrators and attending physicians to preserve nutrition and hydration for Terri Schiavo to allow Congress to fully understand the procedures and practices that are currently keeping her alive," House Speaker Dennis Hastert, Majority Leader Tom DeLay, and Government Reform Committee Chairman Tom Davis said in a statement. "The subpoena will be joined by a Senate investigation as well.

"This inquiry should give hope to Terri, her parents and friends, and the millions of people throughout the world who are praying for her safety. This fight is not over."

I don't know much about this brain dead woman's case (even though I guess this is taking place in my city, I don't watch or read the MSM) but the whole thing sounds like another OJ/ Jackson/ Peterson style media made distraction. what's so special about this one woman?

6. My husband needs medical care
How about an act for him to receive it so he can stay alive. In fact, if they pass this thing, how about a class action suit from all of us who don't have medical care to demand we receive the procedures and practices necessary to keep us alive. We're certainly as worthy as Terri Schiavo.

I'm starting to think this might create quite a precedence.

Takes away Spousal Rights. It means GOVERNMENT will have the final say in your death, not your spouse. So, even if you are married, you better start making out your Living Will AND appointing a Health Proxy/Power of Attorney. Your husband or wife's word on your wishes won't be good enough.

Check this out ...

<snip> First Time In US History and it happens in Texas, go figure: Sun's death marks the first time a hospital has been allowed by a U.S. judge to discontinue an infant's life-sustaining care against a parent's wishes, according to bioethical experts. A similar case involving a 68-year-old man in a chronic vegetative state at another Houston hospital is before a court now. http://www.chron.com/cs/CDA/ssistory.mpl/metropolitan/3084934

and this

<snip> A Houston-area hospital has the right to halt life-support measures for a 68-year-old Friendswood man, despite his wife's objections, a judge ruled Wednesday.

112. health care for all is more important
I can deal with having to get a power of attorney if the trade-off is a federal right to health care. If Congress keeps screwing around in the Terri Schiavo case, that's exactly what they're going to end up doing. Whether they realize it or not.

I'm no lawyer, but every subpoena I've ever seen or heard of demands documents, or a person to appear, but never a "don't do something until I say it's OK' statement.

12. consider this for a moment
Assume Terri Schiavo actually is aware of her surroundings

She is a prisoner in her own body. She can't feed herself, perform bodily functions, or move about. The only she has is her mind, and she can't even communicate her thoughts

I only hope that these wonderful people who are condemning terri schiavo to this existence have the opportunity to experience it themselves

... in this instance? These people are stupid. A subpoena is a demand for appearance and testimony, not a request for a stay, which would be the requirement at this time, given that state courts have given the go-ahead for disconnection of her feeding tube effective tomorrow.

Hastert and DeLay must be delusional.

So far I understand that:

1. It's not alright to kill fetus', even when they may kill their mother.
2. It's okay to execute prisoners even if they are retarded.
3. It's not okay to kill vegetables who may be missing a substantial part of their brain
4. It's okay to kill all men, women and children in Iraq

What I don't understand is:
Your interpretation of "thou shalt not kill". Apparently you have added an "except" to this.

46. The Evangelical Cult at work........The CAUSE USA

Part of TheCause USA, the Amabiles live with others in the group in a Maryland dorm-like facility. The organization, made up of primarily college-aged kids, was founded by Lou Engle, an evangelical activist pastor.they hand out roses while protesting.

The supporters came to pray, to fast and to sing. A few danced as a quartet performed a youthful blend of spiritual tunes.

An evangelical pastor asked Paul Amabile in December to move his family of eight across the country.

In less than a month, Amabile quit a sales job in Kansas City, Mo., and relocated his family to the Washington, DC

Amabile said when the family isn't in Washington, they travel around the nation protesting different causes. Next they will go to Alabama.

..............they want to overturn the 1973 Roe vs. Wade Supreme Court abortion decision. ...........Instead of roaming the country sitting-in for civil rights, ...........they travel arguing the right to life.............

Amabile said his family doesn't mind the traveling and he doesn't mind not working. His friends and former co-workers were supportive of the move, he said.

"People were supportive, a lot gave me money and said, "Here's the first donation,"' he said. "Now we live on support, like missionaries.

No quotes from his website, either. Seems like he'd be all over this. Maybe he doesn't want to ruffle the ACLU's feathers since they're sympathetic to his case. I'm not a listener, so maybe I've missed it, but I haven't seen any mention.

This won't work. She is incapable of testifying before Congress and the Panderers to the Religiously Insane know it.

This will be thrown out before noon. Count on it.

IIRC The Florida legislature tried the same tactic at one point and were excoriated by the courts for such a blatant abuse of power.

GOP Asks Brain-Damaged Woman to Testify

By JESSE J. HOLLAND, Associated Press Writer

WASHINGTON - Senate Republicans embroiled in the life-or-death legal battle over the severely brain-damagedTerri Schiavo invited the Florida woman to testify to Congress in a procedural move intended to keep her on life support.

The Senate Health Committee has requested that Terri and her husband Michael appear at an official committee hearing on March 28. A statement from the office of House Majority Leader Bill Frist, R-Tenn., on Friday said the purpose of the hearing was to review health care policies and practices relevant to the care of non-ambulatory people.

They're going to get somebody with a brain injury who recovered enough funciton to testify.

Fucking lunatics don't realize there's a difference between these folks who are still able to think, feel, and act and a person whose body is basically without a brain and the capacity to do anything beyond autonomic functions and random movements.

I truly hate any politician who thinks he can practice medicine. They always end up doing great harm to a lot of people.

106. You know, it is just amazing..................
Here is a woman who told her husband that she did not want to be kep alive this way, and yet we have an unprecedented attempt to subvert that wish.

Yet, where are these representatives when it comes to people who WANT to go on. Those who can't afford to get the medical care or operation or maybe an alternative procedure that might keep them alive? Where are the voices for thousands of people who would do anything to get the care they need but can't afford to do so?

This is one screwed up country we live in. Commissions on steroid use, bills to help the boy scouts, and this. With all the serious stuff going on in this country and they have no problem putting together a commission on steroid use in just a few weeks. There is something seriously wrong with these people.

My suggestion. Is there any way we can have an investigation of the Congress and the Senate? They are the ones that need to be scrutinized. What are they doing with all of our money, and why? Why are they focusing on the trivial while the important issues are neglected? Why are they continuing to protect a corrupt administration? There are a lot of issues I think we could investigate when it comes to these cretons.

115. DeLay Says He's Not Giving Up Schiavo Fight
March 19, 2005 — House Majority Leader Tom DeLay, R-Texas, said that he and other Republican members of Congress would continue to work through the weekend to come up with a bill to force doctors to reinsert Terri Schiavo's feeding tube.

After a heated legal and political battle, the brain-damaged woman's feeding tube was removed Friday afternoon, despite a last-ditch effort by Congress to prevent it.

On Friday, House Republicans took the extraordinary step of subpoenaing Terri Schiavo to testify before a Congressional committee, but a Florida judge refused that order. Then late Friday, a House committee filed an emergency request with the U.S. Supreme Court, asking justices to reinsert Schiavo's feeding tube while the committee files appeals.

The Supreme Court denied that appeal without comment, and in a statement issued Saturday, DeLay called the court's decision a "moral and legal tragedy."

"The depleted uranium residues our heroic troops have spread across the lands of those godless Muslim children will slowly kill them and deform future generations for decades, similar to the ways I poisoned roaches in Houston. This is a moral triumph for the followers of General Jesus, our vengeful lord of hate, " the proud radical wrong wing reactionary stated, unaware of the irony.

Republicans care about the lives of unborn fetuses and brain dead people on life-support.

If I am at that point, I cannot experience anything. I cannot feel anything. I could not imagine being stuck in that limbo for 15 years. If I get to that point, just let me die. I am assuming that they exhausted all their options up to that point. Why do they want this poor woman to continue suffering?

Brain injury therapy being underfunded (bush slashed funding)

http://www.timesargus.com/apps/pbcs.dll/article?AID=/20...

March 18, 2005

According to doctors at Walter Reed Army Medical Center in Washington, D.C., 60 percent of the wounded soldiers coming back from Iraq have traumatic brain injuries.

Unfortunately, the Bush administration has recently completely zeroed out funding for the Federal TBI Act, which provides exactly this kind of help.

In Vermont, due to recent decisions concerning budgetary shortfalls, TBI survivors are now prevented from entering the Vermont TBI Medicaid Waiver Program, which delivers exactly this kind of help.

Please call the governor (802) 828-3345 and our congressional representatives and ask them to support the Vermont TBI Medicaid Waiver Program.

145. For once, Tom DeLay is doing the right thing.

The right is notoriously bad about cutting benefits to care for the disabled but at least they don't want to kill us. The left will throw us a bone now and then but if we seem inconvenient and someone claims we want to die, they're all for offing us.

WHY???

Here's a short explanation from Mary Johnson's introduction to her book "Make Them Go Away: Clint Eastwood, Christopher Reeve, and the Case Against Disability Rights."

"The case against disability rights had the same "you can't make me!" free-market histrionics one always got from social conservatives when it came to civil rights issues. The difference was that in this case, almost no liberal groups spoke out in support of disability rights."

"Why was that? Most liberals and progressives believed that the problems racial minorities, women and gays faced were the result of animus, the work of a discriminatory society. When it came to disabled people, though, liberals' views were similar to those of the anti's. They believed disabled people faced essentially private, medical problems rather than problems of discrimination. What a disabled person needed, they felt, was medical intervention -- a cure. Lacking that, they should be given help, through private charity or government benefits programs."

(Emphasis added)

173. Tom Delay has never done the right thing
You cannot do the right thing for the wrong reason, this has been going on for over a decade, and only now at the end does Delay get involved.

He got involved for nothing more then to make his own crooked ass look good to the Xtian Taliban, who seem to have all the time in the world to sit outside of a hospice, but can't seem to bring themselves to help the homeless or other disabled people.

By the way, when that little boy in Texas was having the plug pulled on him, where was your hero Tom Delay and these other clowns at? Could it be that because the child was black, that no one cared, of course down in Texas, when a judge decides to pull the plug it's okay.

What's your take on Sun Hudson by the way, should the Xtian Taliban also have gotten involved in that case as well, or is there concern only directed at white women who live in Florida?

Anyone with a brain in their head and a conscience would let this woman die.

This ia another example of why I scoff at fundamentalists. If heaven is so much better than life on Earth, then why does letting this woman die cause a conflict?

Clearly, technological developments have out-paced the average human brain. Who needs to go to the zoo? This country is one big Jungle Habitat full of animals pretending to be something completely different from all of the other life forms on this planet.
